The Committee considers, in accordance with its general comment No. 16 (HRI/GEN/1/Rev.4 of 7 February 2000) that the concept of arbitrariness in article 17 is intended to guarantee that even interference provided for by law should be in accordance with the provisions, aims and objectives of the Covenant and should be, in any event, reasonable in the particular circumstances.

It recommends that the State party ensure that the mechanism be readily accessible to children and provided with sufficient human, technical and financial resources to ensure its independence and efficacy, in accordance with its general comment No. 2 (2002) on the role of independent human rights institutions in the promotion and protection of the rights of the child .
