The Court has jurisdiction in accordance with this Statute with respect to the following crimes:

After it has heard the arguments of the Prosecutor and the State or person concerned, it can either confirm its decision of inadmissibility or authorize the Prosecutor to initiate a prosecution before it in accordance with this Statute.
وبعد الاستماع إلى حجج المدعي العام والدولة والشخص المعني، لها أن تؤكد قرار عدم المقبولية، أو أن تأذن للمدعي العام بالشروع في الملاحقات أمامها وفقا لهذا النظام اﻷساسي.

States Parties shall undertake to extradite to the Court any fugitive requested for extradition and found in their territories in accordance with this Statute and their national laws.
تتعهد الدول اﻷطراف بأن تسلم الى المحكمة، وفقا لهذا النظام اﻷساسي ولقوانينها الوطنية، أي مجرم هارب تطلب المحكمة تسليمه ويكون موجودا في أراضيها.

2. The Chamber shall ensure that a trial is fair and expeditious and is conducted in accordance with this Statute and the Rules, with full respect for the rights of the accused and due regard for the protection of victims and witnesses.
٢ - تكفل الدائرة أن تكون المحاكمة عادلة وسريعة وتجري وفقا لهذا النظام اﻷساسي وللقواعد، مع احترام حقوق المتهم احتراما كاملا وإيلاء الاعتبار الواجب لحماية المجني عليهم والشهود.

1. The Procuracy is an independent organ of the Court responsible for the investigation of complaints brought in accordance with this Statute and for the conduct of prosecutions.
١ - هيئة الادعاء جهاز مستقل من أجهزة المحكمة مسؤول عن التحقيق في الشكاوى المقدمة وفقا لهذا النظام اﻷساسي وعن مباشرة الادعاء.

1. Notwithstanding article 21, the Court has jurisdiction in accordance with this Statute with respect to crimes referred to in article 20 as a consequence of the referral of a matter to the Court by the Security Council acting under Chapter VII of the Charter of the United Nations.
١ - مع عدم اﻹخلال بالمادة ٢١، تختص المحكمة وفقا لهذا النظام اﻷساسي بالجرائم المشار إليها في المادة ٢٠ إذا قرر مجلس اﻷمن لدى مباشرته لعمله وفقا للفصل السابع من ميثاق اﻷمم المتحدة إحالة الموضوع إليها.

An accused shall be presumed innocent [until] [unless] [proved guilty] [convicted] in accordance with [this Statute] [law]. [The onus is on the prosecutor to establish the guilt of the accused [beyond reasonable doubt].] [Note 1.

٢- تكفل الدائرة أن تكون المحاكمة عادلة وسريعة وأن تجري وفقا لهذا النظام اﻷساسي وللائحة، مع احترام حقوق المتهم احتراما كاملا وإيلاء الاعتبار الواجب لحماية المجني عليهم والشهود. المادة ٧٥

Any ambiguity in the wording of article 3, paragraph 3, could be clarified by adding the words “in accordance with this Statute” after “State Party”.
واختتم قائلا أن أي غموض في صياغة الفقرة ٣ من المادة ٣ ، يمكن توضيحها بإضافة العبارة " وفقا لهذا النظام اﻷساسي " بعد عبارة " أي دولة طرف " .

The Court shall have jurisdiction in accordance with this Statute with respect to the following crimes: the crime of genocide, crimes against humanity, war crimes and the crime of aggression, whose elements will be adopted by the Assembly of States Parties.” Such a formulation would refocus participants’ attention on the expectations of the international community.
وينبغي للمحكمة أن يكون لها اختصاص وفقا لهذا النظام اﻷساسي فيما يتعلق بالجرائم التالية : " جريمة الابادة الجماعية والجرائم ضد الانسانية وجرائم الحرب وجريمة العدوان ، التي سوف تعتمد أركانها من جمعية الدول اﻷطراف " . ومثل هذه الصيغة سوف تعيد تركيز اهتمام المشتركين على توقعات المجتمع الدولي .

After it has heard the arguments of the Prosecutor and the State or person concerned, it may either find that the conditions of article 35 (a) have been fulfilled or authorize the Prosecutor to initiate a prosecution in accordance with this Statute.
وبعد الاستماع إلى حجج المدعي العام والدولة أو الشخص المعني، ولها أن تعتبر أن الشروط التي تنص عليها الفقرة )أ( من المادة ٣٥ لا تزال قائمة، أو تأذن للمدعي العام بالشروع في الملاحقات وفقا لهذا النظام اﻷساسي.

50. In the context of the question of who might submit cases to the Court, one representative suggested that paragraph 1 of article 4 should be modified to read: " The Court is at all times open to States Members of the United Nations and to all other States in accordance with this Statute. "
٥٠ - وفي سياق مسألة الجهات التي يجوز لها أن تعرض القضايا على المحكمة، اقترح ممثل تعديل الفقرة ١ من المادة ٤ ليكون نصها: " يكون باب الالتجاء إلى المحكمة مفتوحا في كل اﻷوقات أمام الدول اﻷعضاء في اﻷمم المتحدة وجميع الدول اﻷخرى وفقا لهذا النظام اﻷساسي " .

12. Article 4 should be modified to read: " The Court is at all times open to States Members of the United Nations and to all other States in accordance with this Statute " .
١٢ - ومضى يقول إن المادة ٤ ينبغي أن تعدل ليصبح نصها كما يلي: " تكون المحكمة مفتوحة في جميع اﻷوقات للدول اﻷعضاء في اﻷمم المتحدة وجميع الدول اﻷخرى وفقا لهذا النظام اﻷساسي " .

In that same paragraph, the concern expressed by the United Arab Emirates might be met by inserting “in accordance with this Statute” or “under this Statute” to make it clear that the reference was to the powers given by the Statute.
وفي الفقرة ذاتها ، فإن الشاغل الذي يقلق اﻹمارات العربية المتحدة يمكن تلبيته بإدراج عبارة " وفقا لهذا النظام اﻷساسي " أو " بمقتضى هذا النظام اﻷساسي " لتوضيح أن اﻹشارة تقصد السلطات التي يمنحها النظام اﻷساسي .

He further supported the United Kingdom’s suggestion to clarify article 3, paragraph 3, by adding “in accordance with this Statute”, although that paragraph was perhaps out of place under article 3 and might be more appropriately inserted under article 4 or as a separate paragraph.
وأيد كذلك اقتـراح المملكـة المتحدة لتوضيح الفقرة ٣ من المادة ٣ بإضافة عبارة " وفقا لهذا النظام اﻷساسي ، رغم أن هذه الفقرة ربما ليس لا محل لها في إطار المادة ٣ وربما يكون من اﻷنسب إدراجها فـي إطـار المادة ٤ أو كفقرة مستقلة .
