The Committee wishes to recall in this respect that the mere fact that equal rights are granted to all individuals and that all individuals are equal before the law does not preclude the existence in fact of minorities in a country, and their entitlement to the enjoyment of their culture, the practice of their religion or the use of their language in community with other members of their group.

For these reasons, the Committee concludes that the effects of logging carried out in the Pyhäjärvi, Kirkkoouta and Paadarskaidi areas have not been shown to be serious enough as to amount to a denial of the authors' right to enjoy their own culture in community with other members of their group under article 27 of the Covenant.

In the present case, and taking into account the specific elements brought to its attention, it must consider the effects of these measures not at one particular point in time either immediately before or after the measures are carried out but the effects of past, present and planned future logging on the authors' ability to enjoy their culture in community with other members of their group.

Taking into consideration all the information submitted by the authors and the State party, the Committee concluded that the effects of logging carried out in the areas in question had not been shown to be serious enough as to amount to a denial of the authors' right to enjoy their own culture in community with other members of their group under article 27 of the Covenant.
