If States do take deliberately retrogressive measures, then they have the burden of proving that they first carefully considered all alternatives, and that the measures " are duly justified by reference to the totality of the rights provided for in the Covenant in the context of the full use of the State party's maximum available resources " (para. 32).

4- والقول إن المادة 6 لا تُنتهك إلا عند وفاة الضحايا يعني تضييق مفهوم الحق في الحياة بل وأيضاً إغفال حقيقة أن واجب ضمان الحقوق يشمل كل حق من الحقوق المبينة في العهد (في هذه الحالة الحق في الحياة) حيث يرد بشأن كل منها حكم قانوني معين (في هذه الحالة المادة 6).
