(ii) The carrier has not intentionally failed to determine whether a material statement in the transport document or electronic record is materially false or misleading because it believes that the statement is likely to be false or misleading;
`2` لم يكن قد أغفل عمدا تقرير ما اذا كان أي بيان مادي في مستند النقل أو السجل الالكتروني زائفا في مضمونه أو مضللا، لاعتقاده بأن البيان هو على الأرجح زائف في مضمونه أو مضلل؛

1. If a carrier is identified by name in the contract particulars, any other information in the transport document or electronic transport record relating to the identity of the carrier shall have no effect to the extent that it is inconsistent with that identification.
1- إذا كان الناقل محددا بالاسم في تفاصيل العقد، لم يعد لأي معلومات أخرى واردة في مستند النقل أو سجل النقل الإلكتروني فيما يتعلق بهوية الناقل أي مفعول قانوني متى كانت لا تتسق مع ذلك الاسم المحدّد.

(b) The carrier has reasonable grounds to believe that a material statement in the transport document or electronic transport record is false or misleading.
(ب) كانت لدى الناقل أسباب معقولة للاعتقاد بأن بيانا أساسيا في مستند النقل أو سجل النقل الإلكتروني زائف أو مضلّل.
