103. While legislative measures are necessary in order to prohibit and sanction the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as acts of violence or incitement to such acts against a specific group of persons, the Special Rapporteur is of the view that legislative measures on their own are usually insufficient to effectively prevent and combat the aforementioned phenomena.

106. As mentioned by some States in their replies summarized above, the existence of accessible and effective remedies is an absolute necessity to deter and fight the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as acts of violence or incitement to such acts against a specific group of persons.
