Finally, the State party objects to the information provided by the author in the submission of 14 April 2011, and claims that the facts and circumstances of the case quoted are different from and irrelevant to the present case.

8.4 With regard to the allegations of the violation of articles 14, paragraph 1, and 26 of the Covenant on the grounds that the author was denied the possibility of appearing before the Constitutional Court without being represented by counsel, the Committee considers that the information provided by the author does not describe a situation which comes within the scope of those articles.
8-4 وفيما يتعلق بادعاءات انتهاك الفقرة 1 من المادة 14 من العهد والمادة 26 منه على أساس أن صاحب البلاغ حرم من إمكانية المثول أمام المحكمة الدستورية بدون أن يوَكِّل محامياً يمثله، ترى اللجنة أن المعلومات التي قدمها صاحب البلاغ لا تصف حالة تندرج في نطاق المادتين المذكورتين.

The State party adds that, without seeking to contest the Committee's Views, the decision was adopted on the basis of information provided by the author only, as the State party regrettably could not participate in the procedure.

Sri Lanka), the Committee noted that the State party had not contested the information provided by the author on his deplorable conditions of detention, such as that he was incarcerated in a small and filthy cell, in which he was kept for twenty-three and a half hours a day with inadequate food.

6.4 The Committee notes that the State party has not contested the information provided by the author on his deplorable conditions of pretrial detention and current detention on death row, including the claims that he was initially detained secretly, assaulted, handcuffed and shackled, denied food and water for three days and is currently incarcerated in a small and filthy cell without adequate toilet facilities.
6-4 وتلاحظ اللجنة أن الدولة الطرف لم تعترض على المعلومات التي قدمها صاحب البلاغ بشأن ظروف احتجازه التعيسة في مرحلة ما قبل المحاكمة وحالياً في جناح المحكوم عليهم بالإعدام، بما في ذلك الادعاءات المتعلقة بأنه أودع رهن الاحتجاز السري في البداية، واعتُدي عليه، وقيّد بالأصفاد والأغلال، وحُرم من الغذاء والماء لمدة ثلاثة أيام، وهو حالياً مسجون في زنزانة صغيرة ووسخة لا توجد فيها مرافق صحية ملائمة.

In conclusion, counsel submits that according to the information provided by the author, there exist substantial grounds to believe that the author would be subjected to torture if returned to the Islamic Republic of Iran and that the author has provided reasonable explanations for why she has not been able to or not wished to furnish certain details.
وختاماً، تؤكد المحامية أنه وفقاً للمعلومات التي قدمتها صاحبة البلاغ توجد أسباب حقيقية تدعو إلى الاعتقاد أن صاحبة البلاغ معرضة للتعذيب إذا ما أعيدت إلى إيران وأنها قدمت تعليلات معقولة لعدم تمكنها من تقديم بعض التفاصيل أو عدم رغبتها في ذلك.
