"
125- ويعرّف قانون العقوبات الجديد جريمة التعذيب وغيره من ضروب المعاملة اللاإنسانية والقاسية على النحو التالي: " يعاقَب بالسجن لمدة تتراوح بين ستة أشهر وخمسة أعوام كل من تسبّب في معاناة بدنية أو نفسية لشخص آخر بتعذيبه أو معاملته معاملة لا إنسانية وقاسية في إطار مزاولة السلطة التقديرية لإدارة حكومية، أو حكومة إقليمية، أو محكمة أو أي سلطة عمومية " .

The Criminal Code also regulates the criminal penalty imposed on any person who, in connection with the exercise of the powers of a State authority, local authority or court, subjects another person to physical or psychological suffering by torture or other inhuman and cruel treatment (section 259a of the Criminal Code).
