The Panel also considered the fact that the employing party in each situation was Iraq itself and the fact that Iraq’s invasion and occupation of Kuwait raised a credible and serious threat of retaliatory military action in Iraq so as to be a deterrent to travel to Iraq.

٩ - وفي شهر نيسان/أبريل، تزمع اللجنة ايفاد فريق الى العراق لاجراء مقابلة مع كبار الموظفين العراقيين الذين قام العراق ذاته باجراء مقابلات معهم، في إطار الجهود التي يبذلها لانجاز تقاريره عن برنامجه السابق لﻷسلحة الكيميائية.

Paragraph 8 states that “(w)here Iraq itself was a contracting party and breached its contractual obligations, Iraq is liable under general contract law to compensate for all actual losses suffered by the other contracting party...”.
فقد جاء في الفقرة ٨ أنه " إذا كان العراق ذاته طرفاً متعاقداً وأخل بالتزاماته التعاقدية، يكون العراق مسؤولاً بموجب قانون العقود العام عن التعويض عن جميع الخسائر الفعلية التي تكبدها الطرف المتعاقد اﻵخر ... " .

The Panel considered it significant that Iraq itself made these data available to the Commission, confirming that the individuals covered had departed from Iraq during the jurisdictional period.
