For instance, if a Contracting State believes that one of its laws prevents it from providing the other Contracting State with information as to the beneficial owners of its resident companies or other juridical persons, it is obligated to give written notice of that position during the negotiation of the convention, with an explanation of the impact of that law on its obligations in relation to mutual assistance.

The new French Criminal Code does, admittedly, establish the criminal responsibility of juridical persons but it excludes the State.
ولا جرم أن القانون الجنائي الفرنسي الجديد ينص على المسؤولية الجنائية لﻷشخاص المعنويين غير أنه يستثني الدولة منهم.

2. The criminal responsibility of juridical persons shall not exclude the criminal responsibility of physical persons who are perpetrators of or accomplices in the same crimes.
٢ - ولا تستثني المسؤولية الجنائية لﻷشخاص الاعتباريين المسؤولية المترتبة على اﻷشخاص الطبيعيين الذين ارتكبوا الجرائم ذاتها أو كانوا شركاء فيها.

Such a convention would provide a certainty and predictability that would benefit the States themselves, the individuals and juridical persons with whom they dealt and their legal advisers, in addition to contributing to the process of codification and progressive development of international law.
