Article 11, paragraph 1, of the draft adopted by the Commission in 1991 laid down the general principle that, unless otherwise agreed between the States concerned, a State could not invoke immunity from jurisdiction before a court of another State which was otherwise competent in a proceeding which related to a contract of employment.

Her delegation was in favour of option 3 for article 7 regarding States that should be parties or have accepted jurisdiction before the Court exercised its jurisdiction.
