Article 253: The Department of Public Prosecutions or the competent court may take receipt of a letter rogatory sent to it through the diplomatic channel by a foreign authority.

A letter rogatory shall be submitted through the diplomatic channel and executed in the following manner:

In accordance with a practice adopted under an agreement with the Ministry of Justice, the Anti-Corruption Public Prosecutor's Office and the Anti-Corruption Court, however, the Brigade may launch an investigation without a letter rogatory for those persons because the agreement has the effect of a general letter rogatory.
ألا أنه وفقاً لممارسة معتمدة بموجب اتفاق مبرم بين وزارة العدل ومكتب المدعي العام المختص بمكافحة الفساد والمحكمة المختصة بمكافحة الفساد، يجوز للفرقة البدء في تحقيقات دون تفويض قضائي بشأن هؤلاء الأشخاص حيث اعتبر الاتفاق بمثابة تفويض قضائي عام.

If the requesting State wishes the letter rogatory to be executed by a different method, the receiving authority shall accede to its request, provided that it would not in so doing be acting in contravention of the laws of the requested State.

A judicial procedure instituted in response to a letter rogatory that has been submitted in accordance with the provisions set out above shall have the same legal effect as it would have had if it had been instituted by the competent authority in the requesting State.
ثالثاً: يكون للإجراء القضائي الذي تم بواسطة إنابة قضائية وفقاً للأحكام المتقدمة الأثر القانوني نفسه الذي يكون له فيما لو تم أمام السلطة المختصة في الدولة الطالبة.

However, such requests can be dealt with on a case-by-case basis, based on a request received or if the request is made through an Agreement between the parties involved or through a letter rogatory.

Such requests may be based on a bilateral mutual legal assistance treaty, multilateral convention, or reciprocity, particularly in the case of a letter rogatory or letter of request.

Detention imposed on the basis of paragraph 1 of this article may be terminated if no letter rogatory is submitted within 18 days of the day when the person whose extradition is sought was remanded to detention.

The letter rogatory must include the necessary background information and indicate the questions to be put to the witness; however, the foreign authority or court may expand upon them as dictated by its discretion and good judgement.

The letter rogatory shall be submitted through the diplomatic channel and executed in the following manner:

A request for legal assistance or an international letter rogatory should be submitted in writing, duly translated into Spanish, through the diplomatic channel, i.e., through the Ministry of Foreign Affairs.
ينبغي تقديم طلب المساعدة أو الإنابة القضائية الدولية خطيا، مترجما إلى الإسبانية على النحو الواجب، عن طريق القنوات الدبلوماسية، أي وزارة الشؤون الخارجية.

(i) by not acting upon its undertaking of 27 January 2005 to execute the letter rogatory addressed to it by the Republic of Djibouti dated 3 November 2004;

" (a) The competent judicial authority shall execute a letter rogatory in accordance with its own procedural rules.
" (أ) تقوم السلطة القضائية المختصة بتنفيذ الإنابة المطلوبة منها طبقاً للإجراءات القانونية المتبعة لديها.

Any judicial procedure instituted pursuant to a letter rogatory in accordance with the preceding provisions shall have the same legal effect as it would have had, if it had been instituted before the competent authority in the requesting State.
