61. While, at one end of the spectrum, FDI is recognized as a relatively stable source of finance, at the other end, short-term, pure financial flows (especially short-term commercial bank loans and deposits) give rise to concerns over their volatility.
61 - في الوقت الذي يعترف فيه من جهة بأن الاستثمار المباشر الأجنبي يمثل مصدرا ثابتا نسبيا للتمويل فإن التدفقات المالية الصرفة لفترات قصيرة (ولا سيما القروض والودائع المصرفية التجارية قصيرة الأجل) تثير القلق بشأن تقلبها من الجهة الأخرى.

First, Kuwait argued that payment was not due under the loans and deposits, and accordingly the debts and obligations had not arisen prior to 2 August 1990, because “Kuwait had not demanded repayment and Iraq had not indicated that it was financially unable to repay”, and that “Iraq acknowledged its obligation to repay these loans and deposits”, in that “it complained that Kuwait had not forgiven them”.
529- وقالت الكويت، أولاً، إن الدّفع لم يكن مستحقّاً بموجب القروض والودائع، وبالتالي فإنّ الديون والالتزامات لم تنشأ قبل 2 آب/أغسطس 1990، لأن " الكويت لم تطالب بالتسديد، والعراق لم يذكر أنه عاجز عن التسديد " ، ولأن " العراق قد اعترف بالتزامه بتسديد هذه القروض والودائع " ، بما أنه " اشتكى من أن الكويت لم تعفيه منها " .

Kuwait noted that the exclusionary language of paragraph 16 of Security Council resolution 687 (1991) “contemplates the existence of ‘normal mechanisms’ to recover pre-invasion debts and obligations, but Kuwait has no normal mechanisms through which to assert its right against Iraq regarding the loans and deposits”.
