The draft resolution called upon States to exercise vigilance in regard to the threat posed by the activities of mercenaries, keeping in mind the new legal definition of a mercenary proposed by the Special Rapporteur on use of mercenaries as a means of impeding the right of peoples to self-determination in his report to the sixtieth session of the Commission on Human Rights.

43. The Special Rapporteur has formulated a proposal for a new legal definition of a mercenary, with the following major elements:

The General Assembly further requested the Working Group to continue the work already done by the previous Special Rapporteurs on the strengthening of the international legal framework for the prevention and sanction of the recruitment, use, financing and training of mercenaries, taking into account the proposal for a new legal definition of a mercenary, as drafted by the first Special Rapporteur.
