One of the fundamentals of the right to due process for everyone charged with a criminal offence is to “examine, or have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him”. (Covenant on Civil and Political Rights, art. 14,3 (e)).

3.9 The author claims that the prosecution's inability to ensure the appearance of Mr. A.R. in court, despite his and his lawyer's numerous requests resulted in a violation of his right to examine the witnesses against him and to obtain the attendance and examination of witnesses on his behalf, guaranteed under article 14, paragraph 3(e), of the Covenant.

3.2 The author further alleges a violation of article 14, paragraph 3 (e), in that he had insufficient opportunity to examine, or have examined, the witnesses against him at trial, and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him.
