4. Article 4(3) of annex III to the Convention stipulates that:

Having examined the particulars submitted by the applicant, which are summarized in sections III to VII above, the Commission is satisfied that the application has been duly submitted in accordance with the Regulations and that the applicant is a qualified applicant, as defined in articles 4 and 9 of annex III to the Convention, and regulation 17 of the Regulations.

13. The certificate of sponsorship states that the United Kingdom assumes responsibility for the activities of the applicant, in accordance with article 139 and paragraph 4 of article 153 of the Convention and paragraph 4 of article 4 of annex III to the Convention.
١٣ - وتشير شهادة التزكية إلى أن المملكة المتحدة تتحمَّل المسؤولية عن كل ما يقوم به مُقدِّم الطلب من أنشطة وفقا للمادة 139 والفقرة 4 من المادة 153 من الاتفاقية وتمشيا مع الفقرة 4 من المادة 4 من المرفق الثالث للاتفاقية.

3. Nevertheless, article 6 of annex III to the Convention contains provisions, in its paragraphs 3 (c) and 4, that are intended to prevent one entity from gaining a dominant position in the Area.
3 - غير أن المادة 6 من المرفق الثالث للاتفاقية تتضمن في الفقرتين (3) (ج) و (4) أحكاما تهدف إلى منع كيان واحد من إحراز مركز مسيطر في المنطقة.

Article 6, paragraph 3 (c), of annex III to the Convention was reproduced with minor modifications in regulation 21, paragraph 6 (d), of the Regulations, which reads as follows:

9. While it is a safe way to reproduce the provision of the Convention which reflects the best available compromise for achieving a solution, the practical application of this provision is problematic, as with article 6, paragraph 3 (c), of annex III to the Convention.

13. The certificate of sponsorship states that the nationality of the applicant is Japanese and that the sponsoring State sponsors the applicant in accordance with paragraph 2 (b) of article 153 of the United Nations Convention on the Law of the Sea and paragraph 4 of article 4 of annex III to the Convention and subject to its relevant national laws and regulations.

24. Having examined the particulars submitted by the applicant, which are summarized in sections III to VII above, the Commission is satisfied that the application has been duly submitted in accordance with the regulations and that the applicant is a qualified applicant, as defined in articles 4 and 9 of annex III to the Convention, and regulation 17 of the regulations.

22.2 The Authority shall not unreasonably withhold consent to the transfer if the proposed transferee is in all respects a qualified applicant in accordance with the Regulations and assumes all of the obligations of the Contractor and if the transfer does not confer to the transferee a plan of work, the approval of which would be forbidden by article 6, paragraph 3 (c), of annex III to the Convention.
22-2 لا يجوز أن تمتنع السلطة بدون مبررات معقولة عن منح موافقتها على النقل إذا توافرت في الطرف المراد نقل هذه الحقوق والالتزامات إليه من جميع النواحي مؤهلات مقدم الطلب وفقا للنظام، واضطلع بجميع التزامات المتعاقد، وإذا كان النقل لا يمنح المنقول إليه الحق في خطة عمل تحظرها الفقرة 3 (ج) من المادة 6 من المرفق الثالث للاتفاقية.

4. Notwithstanding the provisions in paragraph 2 above, where an applicant has elected to contribute a reserved area to carry out activities pursuant to article 9 of annex III to the Convention, in accordance with regulation 17, the total area covered by an application shall not exceed 200 cobalt crust blocks.
