(e) When the commission of any of the offences referred to in paragraph 1 of this article requires proof of the knowledge, intent, aim, purpose or agreement for the commission of such offences, these may be inferred from objective factual circumstances.

(a) Ensure that child victims of any of the offences under the Optional Protocol are as such neither criminalized nor penalized and that all possible measures are taken to avoid the stigmatization and social marginalization of these children;

(d) Whether the State party, since the entry into force of the Protocol, has refused any request(s) for the extradition of a person subject to its jurisdiction who was accused by another State of any of the offences referred to in the present Protocol and, if so, the reason for the refusal(s) to extradite, and whether the person(s) concerned was referred to the competent authorities of the State party for prosecution;
(د) إن كانت الدولة الطرف قد رفضت، منذ دخول البروتوكول حيز النفاذ، أي طلب لتسليم شخص يخضع لولايتها القضائية تتهمه دولة أخرى بأي من الجرائم الوارد ذكرها في هذا البروتوكول، وفي هذه الحالة، ينبغي ذكر سبب رفض التسليم، وما إن كان الشخص المعني قد تمت إحالته إلى السلطات المختصة في الدولة الطرف لمحاكمته؛

48. The records of the criminal courts and the juvenile court show that, during the period 2001 to 2004, no trials of any of the offences enumerated in the Optional Protocol were held. The sharia courts also report that they tried no cases of this kind during the same period.
48- أفادت المحاكم العدلية بأنه تبين من سجلات المحكمة الجنائية الصغرى والكبرى ومحكمة الأحداث أن هذه المحاكم لم تنظر في أية جريمة من الجرائم المنصوص عليها في البروتوكول الاختياري خلال السنوات من 2001 إلى 2004، كما أفادت المحاكم الشرعية بأنها لم تتعرض لقضايا من هذا القبيل خلال الفترة المشار إليها.

(c) His testimony is not admissible as legal evidence if, before pronouncing judgement, the court finds that he has been convicted, under the terms of a final judgement, of any of the offences specified in the Act;
)ج( عدم قبول شهادته أمام القضاء إذا ثبت للمحكمة قبل النطق بالحكم أنه أدين نهائيا في إحدى الجرائم المنصوص عليها في هذا القانون؛

2. If the penalty imposed has not been served in full or if the person accused was acquitted of any of the offences specified in articles 9 and 12 on the ground that it was not punishable under the law of the land, the said person may be prosecuted in Iraq.
