Under article 23 of Organization Act No. 4/2000 on Rights and Freedoms of foreigners in Spain and their Social Integration of 11 January 2000, " Any treatment deriving from the adoption of criteria prejudicial to workers because they are foreign or belong to a specific race, religion, ethnic group or nationality " is considered to be indirect discrimination.

A recent reform of Organic Law No. 4/2000 on Rights and Freedoms of foreigners in Spain and their Social Integration (the Aliens Act) enables women victims of gender violence reunited with their families in Spain to receive an independent residence permit after the issuance of a protection order.

18. The Government reported that organic Law 4/2000, on the rights and freedoms of foreigners in Spain and their social integration, had provided for the establishment of the Spanish Observatory on Racism and Xenophobia (article 71), which was mandated to conduct studies on, and formulate proposals for action to combat racism and xenophobia against migrants in Spain.

18. The basic regulatory provision which gives effect to the constitutional mandate established in the above-mentioned article 13, paragraph 1, of the Constitution is Organization Act No. 4/2000 of 11 January 2000 on rights and freedoms of foreigners in Spain and their integration into society, as amended by Organization Act No. 8/2000 of 22 December 2000.

Organic Act No. 10/2011 amended article 59 bis of Organic Act No. 4/2000 on the rights and freedoms of foreigners in Spain and their social integration, so as to enhance protection for foreign women in an irregular situation who are potential victims of trafficking and to encourage them to cooperate with the authorities in the investigation of trafficking offences.
ويجدر في هذه النقطة إضافة أن المادة 59 مكرراً من القانون الأساسي رقم 4/2000 لحقوق وحريات الأجانب في إسبانيا واندماجهم الاجتماعي قد عُدلت بموجب القانون الأساسي رقم 10/2011، بهدف تحسين مستوى حماية ضحايا الاتجار الأجانب المحتملين الذين هم في وضع غير نظامي، فضلاً عن تيسير تعاونهم مع السلطات في التحقيق في هذه الجرائم(18).

82. Royal Decree 2393/2004 of 30 December, approving the regulations to Organic Law 4/2000 of 11 January on the rights, freedoms and social integration of foreigners in Spain, allows for waiving liability and expulsion for such persons if they collaborate with the authorities, provide essential data, or give testimony as victim, injured party or witness in legal proceedings involving the crime of human trafficking.
