وفي الحالات التي يتعذر فيها العثور على والدي الطفل أو أفراد أسرته اﻵخرين، يمنح الطفل ذات الحماية الممنوحة ﻷي طفل آخر محروم بصفة دائمة أو مؤقتة من بيئته العائلية ﻷي سبب كما هو موضح في هذه الاتفاقية.

123. Article 20 states that “A child temporarily or permanently deprived of his or her family environment ... shall be entitled to special protection and assistance provided by the State”.

The State party is under the obligation " to ensure the child such protection and care as is necessary for his or her well-being " (art. 3, para. 2) and to " ensure alternative care " to " a child temporarily or permanently deprived of his or her family environment " (art. 20).
