5-2 وفيما يتعلق بزعم الدولة الطرف بعدم وجود إثبات للادعاءات، يرى صاحب البلاغ أنه قد أثبت انتهاك حقوقه المنصوص عليها في العهد وقدم الكثير من الحجج لإقامة البرهان على ذلك.

5.3 The author claims that, as in the above-mentioned cases, the violation of his rights under the Covenant has continued after the Optional Protocol entered into force.

7. The problem that arises with the extradition of the author of the communication to the United States without any assurances having been requested is that he was deprived of the enjoyment of his rights under the Covenant.
