The transfer of illicitly acquired assets abroad had consequences on economic growth, sustainable development and poverty eradication; return of such assets to their country of origin was therefore critically important.

2. Each State Party shall adopt such measures as may be necessary, in accordance with its domestic law, for financial institutions within its jurisdiction to apply enhanced scrutiny in order to improve the detection of illicitly acquired assets.
2- تعتمد كل دولة طرف ما قد يلزم من تدابير، وفقا لقانونها الداخلي، لكي تجري المؤسسات المالية الواقعة ضمن ولايتها القضائية فحصا مشددا لأجل تعزيز إمكانية كشف الموجودات المكتسبة بصورة غير مشروعة.

(f) Consider adopting such other measures as may be necessary to facilitate the recovery of illicitly acquired assets.
(و) أن تنظر في اتخاذ ما قد يلزم من تدابير أخرى لتيسير استرداد الموجودات المكتسبة بصورة غير مشروعة.()

1. Each State Party shall adopt such measures as may be necessary, in accordance with its domestic law, for financial institutions within its jurisdiction to apply enhanced scrutiny in order to improve the detection of illicitly acquired assets.
1- تعتمد كل دولة طرف ما قد يلزم من تدابير، وفقا لقانونها الداخلي، لكي تجري المؤسسات المالية الواقعة ضمن ولايتها القضائية فحصا دقيقا يكفل تحسين كشف الموجودات المكتسبة بصورة غير مشروعة.

" (a) Permit the requesting State Party to initiate legal action in the courts of the requested State Party for the purpose of establishing the ownership of illicitly acquired assets located in the territory of the requested State Party, by presenting either:
" (أ) أن تسمح للدولة الطرف الطالبة بأن ترفع دعوى أمام محاكم الدولة الطرف متلقية الطلب لغرض اثبات ملكية الموجودات المكتسبة بصورة غير مشروعة والموجودة في اقليم الدولة الطرف متلقية الطلب بأن تقدم إما:

" (b) Permit its competent authorities to give effect to a final judgement of a competent court of the requesting State Party ordering the confiscation of illicitly acquired assets located in the territory of the requested State Party;
" (ب) أن تسمح لسلطاتها المختصة بانفاذ حكم نهائي صادر عن محكمة مختصة في الدولة الطرف الطالبة يأمر بمصادرة الموجودات المكتسبة بصورة غير مشروعة والموجودة في اقليم الدولة الطرف متلقية الطلب؛

" (e) Adopt such measures as may be necessary to ensure the prompt return of illicitly acquired assets to the requesting State Party; and
" (ﻫ) أن تعتمد ما قد يلزم من تدابير تكفل إرجاع الموجودات المكتسبة بصورة غير مشروعة إلى الدولة الطرف الطالبة على وجه السرعة؛

4. Urges Member States to combat and penalize corruption in all its forms as well as the laundering of proceeds of corruption, to prevent the transfer of illicitly acquired assets, and to work for the prompt return of such assets through asset recovery consistent with the principles of the Convention, particularly chapter V;

Recognizes the efforts of Member States that have enacted laws to prevent and combat corrupt practices and the transfer of illicitly acquired assets and for the return of such assets to the countries of origin, in accordance with the United Nations Convention against Corruption, and encourages Member States that have not yet done so to enact such laws;

(c) Adopt such measures as may be necessary to authorize its courts in confiscation proceedings to adjudicate and recognize another State Party's claim as a legitimate owner of [illicitly acquired assets] prior to ordering confiscation of such property; and
(ج) أن تعتمد ما قد يلزم من تدابير للإذن لمحاكمها في إجراءات المصادرة بالفصل في مطالبة دولة طرف أخرى والاعتراف بتلك المطالبة باعتبارها مالكا شرعيا [للموجودات المكتسبة بصورة غير مشروعة] قبل الأمر بمصادرة تلك الممتلكات؛

The Assembly also urged Member States to combat and penalize corruption as well as the laundering of proceeds of corruption, to prevent the transfer of illicitly acquired assets and to work for the prompt return of such assets.
كما حثّت الجمعية العامة الدول الأعضاء على مكافحة الفساد والمعاقبة عليه، وكذلك غسل العائدات المتأتية من الفساد، وعلى منع تحويل الموجودات المتأتية من مصدر غير مشروع وعلى السعي إلى إعادة هذه الموجودات على وجه السرعة.
