After extensive discussions, the Commission had determined that the draft convention would apply to both the international assignment of receivables and the assignment of international receivables where the assignor was located in a contracting State.

It was observed that the same approach should be followed if Chapter VI were to expand the territorial scope of application of the draft Convention and apply to international assignments or assignments of international receivables irrespective of whether the assignor was located in a Contracting State.
وأشير الى ضرورة اتباع النهج ذاته اذا كان يراد للفصل السادس أن يوسع النطاق الجغرافي لانطباق مشروع الاتفاقية بحيث ينطبق على الاحالات الدولية أو احالات المستحقات الدولية بصرف النظر عما اذا كان مقر المحيل موجودا في دولة متعاقدة .

(a) Assignments of international receivables and to international assignments of receivables as defined in this chapter, if, at the time of conclusion of the contract of assignment, the assignor is located in a Contracting State; and
(أ) على إحالات المستحقات الدولية وعلى الإحالات الدولية للمستحقات حسب تعريفها الوارد في هذا الفصل، إذا كان مقر المحيل واقعا، وقت إبرام عقد الإحالة، في دولة متعاقدة؛

Accordingly, the draft Convention applies to assignments of international receivables, whether or not the assignments are international or domestic, and to international assignments of receivables, even if the receivables are domestic (for comments on internationality, see paras. 38-41).
ومن ثم، فإن مشروع الاتفاقية ينطبق على احالات المستحقات الدولية سواء كانت الاحالات دولية أو محلية، وعلى الاحالات الدولية للمستحقات، حتى وان كانت المستحقات محلية (للاطلاع على التعليقات على الطابع الدولي، انظر الفقرات 38-41).

As regards domestic receivables, the concern was expressed that their assignment raised different issues from the assignment of international receivables and, accordingly, if covered by the draft Convention at all, should be made subject to a different set of rules.
٧٢١ - وبشأن المستحقات المحلية ، أعرب عن شاغل مفاده أن احالة تلك المستحقات تثير مسائل تختلف عن المسائل التي تثيرها احالة المستحقات الدولية وأنه ، تبعا لذلك ، اذا تناولها مشروع الاتفاقية على الاطلاق ، فينبغي أن تخضع لمجموعة مختلفة من القواعد .

" )١( تنطبق هذه الاتفاقية على الاحالات الدولية للمستحقات وعلى احالات المستحقات الدولية من جانب محال اليه أول أو أي محال اليه آخر لمحالين اليهم لاحقين ، حتى ان كانت هذه الاتفاقية لا تسري على الاحالة اﻷولى .

It was noted that the opening words of draft article 1 reflected the decision made by the Working Group at its previous two sessions that the substantive scope of the draft Convention should be broadly drafted to cover both assignments of international receivables and international assignments of domestic receivables, thus excluding only domestic assignments of domestic receivables ((A/CN.9/432, para. 24 and A/CN.9/434, para. 18).
العبارة الاستهلالية ٦٢١ - لوحظ أن العبارة الاستهلالية لمشروع المادة ١ تراعي القرار الذي اتخذه الفريق العامل في دورتيه السابقتين بأن يصاغ النطاق الموضوعي لمشروع الاتفاقية صياغة أوسع لكي يشمل احالات المستحقات الدولية والاحالات الدولية للمستحقات المحلية ، وبذلك لا يستبعد سوى الاحالات المحلية للمستحقات المحلية )A/CN.9/432 ، الفقرة ٤٢ ، و A/CN.9/434 ، الفقرة ٨١( .

However, it is not intended to limit the scope of the draft Convention, for example, only to assignments of receivables generated in international trade, excluding assignments of domestic receivables, or only to international assignments of domestic receivables, excluding domestic assignments of international receivables.
غير أنه لا يقصد منها أن تحد من نطاق مشروع الاتفاقية، وذلك مثلا بأن تجعله قاصرا على احالات المستحقات التي تنشأ في التجارة الدولية، باستبعاد احالات المستحقات المحلية، أو تجعله قاصرا على الاحالات الدولية للمستحقات المحلية، باستبعاد الاحالات المحلية للمستحقات الدولية.
