A procuring entity shall impose no criterion, requirement or procedure with respect to the qualifications of suppliers or contractors other than those provided for in this Law.

3. The procuring entity, when first soliciting the participation of suppliers or contractors in the procurement proceedings, shall specify:

Such means are to be specified by the procuring entity when first soliciting the participation of suppliers or contractors in the procurement proceedings.

In addition, the procuring entity shall hold any meeting of suppliers or contractors using means that ensure that suppliers or contractors can fully and contemporaneously participate in the meeting. "

فالنهوج المتبنّاة إزاء وضع نظام الاشتراء واستخدامه، مثل أي إشراك لأطراف ثالثة في وضع نظام الاتصال واستخدام النظم الحصرية، يكون لها تأثير مباشر على مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء.

Caution should be exercised not to tie legal requirements to a given state of technological development and not to impose higher security measures than otherwise would be applicable in the paper-based environment since these measures can discourage the participation of suppliers or contractors in non-paper-based procurement.
وينبغي الحرص على عدم ربط الاشتراطات القانونية بحالة تطور تقني معيّنة، وعلى عدم فرض تدابير أمنية أشد مما هو مطبّق على نحو آخر في البيئة الورقية؛ لأنَّ تلك التدابير يمكن أن تثني المورِّدين أو المقاولين عن المشاركة في الاشتراء غير الورقي.

The use of electronic catalogues as a source of quotations may in particular be considered to offer better opportunity for transparency in the selection of suppliers or contractors from which to request quotations, in that such selection can be evaluated against those suppliers or contractors offering relevant items in catalogues.
وقد يُنظر على نحو خاص إلى استخدام الفهارس الإلكترونية مصدراً لعروض الأسعار على أنه يتيح فرصة أفضل لتحقيق الشفافية في اختيار المورِّدين أو المقاولين الذين يُطلب منهم تقديم عروض الأسعار، بحيث يمكن تقييم هذا الاختيار بالمقارنة بمورِّدين ومقاولين يعرضون أصنافاً ذات صلة بالموضوع في فهارس.

وتتعلّق الفقرتان بفرض حد أقصى لعدد المورّدين أو المقاولين الأطراف في الاتفاق بسبب المعوّقات التقنية.

(e) The means to be used to hold any meeting of suppliers or contractors.
(ﻫ) الوسائل المراد استخدامها لعقد أيِّ اجتماع للمورِّدين أو المقاولين.

The value of retaining these provisions in the revised model law was emphasized with reference to the Convention against Corruption, as ensuring transparency throughout the process and eliminating any advantageous position of suppliers or contractors that might otherwise gain access to procurement planning phases in a non-transparent way.
وشُدد على أهمية الإبقاء على هذه الأحكام في القانون النموذجي المنقّح فيما يتعلق باتفاقية مكافحة الفساد، من حيث إن هذه الأحكام تضمن الشفافية في جميع مراحل العملية وتستبعد أي وضعية متميزة للموردين أو المقاولين الذين يمكن لولا ذلك أن يصلوا بطريقة غير شفافة إلى مراحل التخطيط للاشتراء.

When first soliciting the participation of suppliers or contractors in the procurement involving open framework agreements, the procuring entity shall specify in addition to the information set out in the preceding article:

وتوصي المادة بنشر معلومات حول عملية الاشتراء في المستقبل مما قد يضفي مزيداً من الشفافية على جميع مراحل عملية الاشتراء ويزيل أيّ مزايا قد يتمتّع بها المورِّدون أو المقاولون الذين يمكنهم أن يطلعوا على مراحل تخطيط عمليات الاشتراء بوسيلة أخرى وعلى نحو غير شفّاف.

Where there is a competitive market of suppliers or contractors anticipated to be qualified to participate in the electronic reverse auction, such that effective competition is ensured; AND
