Any country entering into a treaty wants to ensure that its residents who carry on business in the other contracting State are treated the same as the residents of that other State who carry on similar activities.

2 - لا يمّكن أي حكم من أحكام هذه الاتفاقية دولة طرفا من ممارسة اختصاصات أو مهام في أراض دولة أخرى، تقتصر ممارستها حصريا على سلطات تلك الدولة الأخرى بموجب قانونها المحلي.

The existing article 27 dealt with two separate internationally wrongful acts: the act of a State which by aid or assistance facilitated the commission of an internationally wrongful act by another State, and the unlawful act of that other State, which constituted the principal breach.
وأشير إلى أن المادة 27 الحالية تعالج فعلين مستقلين غير مشروعين دولياً ألا وهما: تصرف دولة يسرت بمعونتها أو مساعدتها ارتكاب دولة أخرى لفعل غير مشروع دولياً، والفعل غير المشروع الذي ارتكبته تلك الدولة الأخرى والذي يشكل الخرق الرئيسي.

(b) Is not named as a party to the proceeding but the proceeding in effect seeks to affect the property, rights, interests or activities of that other State.

A State shall give effect to State immunity under article 5 by refraining from exercising jurisdiction in a proceeding before its courts against another State and to that end shall ensure that its courts determine on their own initiative that the immunity of that other State under article 5 is respected.
1 - تُعمل الدولة حصانة الدول المنصوص عليها في المادة 5 بالامتناع عن ممارسة الولاية القضائية في دعوى مقامة أمام محاكمها ضد دولة أخرى و تضمن لهذه الغاية أن تقرر محاكمها من تلقاء نفسها احترام حصانة تلك الدولة الأخرى بموجب المادة 5.

(b) is not named as a party to the proceeding but the proceeding in effect seeks to affect the property, rights, interests or activities of that other State.
(ب) أو لم تُسم كطرف في الدعوى ولكن الدعوى تهدف في الواقع إلى التأثير في ممتلكات تلك الدولة الأخرى أو في حقوقها أو مصالحها أو أنشطتها.

1. Unless otherwise agreed between the States concerned, a State cannot invoke immunity from jurisdiction before a court of another State which is otherwise competent in a proceeding which relates to a contract of employment between the State and an individual for work performed or to be performed, in whole or in part, in the territory of that other State.
1 - ما لم تتفق الدولتان المعنيتان على غير ذلك، لا يجوز لدولة أن تحتج بالحصانة من الولاية القضائية أمام محكمة دولة أخرى، تكون من جميع الوجوه الأخرى هي المحكمة المختصة، في دعوى تتصل بعقد عمل مبرم بين الدولة وفرد من الأفراد بشأن عمل تم أداؤه أو يتعين أداؤه كليا أو جزئيا في إقليم تلك الدولة الأخرى.

If this finding does not satisfy the other State, the two States shall, at the request of that other State, promptly enter into consultations and negotiations in the manner indicated in paragraphs 1 and 2 of article 17.
وإذا لم يقنع هذا الرأي الدولة اﻷخرى تدخل الدولتان فورا، بناء على طلب هذه الدولة اﻷخرى، في مشاورات ومفاوضات على الوجه المبين في الفقرتين ١ و ٢ من المادة ١٧.
