223. The possibility of increasing the percentage of the pension to more than 100 per cent of the base figure in such cases was recently made available by Royal Legislative Decree No. 16/2001 of 27 December 2001 on measures for the establishment of a gradual and flexible retirement system.

In such cases, the woman worker is entitled to the equivalent of 75 per cent of the base figure (calculated in the same way as the figure applicable to temporary disability resulting from ordinary illness), as from the day her employment contract is suspended because she is pregnant until the start of the maternity leave period or her reinstatement in her previous position or another position compatible with her condition.
