236. Under article 132 of the Children's Rights Act, minors are exempt from paying legal fees and court costs in proceedings brought under the Act or any other law.

Article 131 of the Children's Rights Act provides that juveniles shall be tried in camera, and that only a juvenile's relatives, witnesses, lawyers, and social workers may attend his trial. Furthermore, his name and photograph may not be made public, and no account of the trial, in extenso or abridged, may be published in any form.
307- ونصت المادة 131 من قانون حقوق الطفل على أن تجري محاكمة الحدث بصورة سرية ولا يجوز أن يحضر محاكمة الحدث إلا أقاربه والشهود والمحامون والمراقبون الاجتماعيون كما يحظر نشر اسم وصورة الحدث أو نشر وقائع المحاكمة أو ملخصها في أي وسيله من وسائل النشر.

Chapter 11 of the Children's Rights Act, in the section headed " Penalties " , provides that children are entitled to protection from all forms of exploitation and violation of their rights, and lays down deterrent penalties of varying severity, depending on the criminal offence or infraction committed against a child, by way of protecting children from all forms of discrimination.

Under articles 4 and 5 of the Children's Rights Act, children have the right to life, which is stated to be a fundamental right that cannot be infringed under any circumstances. The State is responsible for their welfare, and endeavours to provide conditions in which children can be brought up satisfactorily and their human dignity respected, in a wholesome environment.
417- وأكد قانون حقوق الطفل في المادتين 4 و5 بأن للطفل الحق في الحياة وهو حق أصيل ولا يجوز المساس به إطلاقاً، وأن تتولى الدولة رعايتهم وتعمل على توفير الظروف التي تكفل تنشئتهم تنشئةً سليمةً تحترم الحرية والكرامة الإنسانية وفي بيئة صحية.

Article 88 of the Constitution states that basic education is compulsory and must be provided by the State free of charge. Article 81 of the Children's Rights Act stipulates that the State must guarantee a free education in accordance with the laws in force.
ونصت المادة 88 منه على أن " التعليم الأساسي إلزامي تكفله الدولة مجاناً " ، كما نصت المادة 81 من قانون حقوق الطفل على أن " تكفل الدولة مجانية التعليم وفقاً للقوانين النافذة " .

235. According to article 131 of the Children's Rights Act, trials of minors must be conducted in camera with only relatives, witnesses, lawyers and social workers attending. It is prohibited to publish a child's name and picture or the facts or a summary of a case in any type of publication.
٢٣٥- ونصت المادة ١٣١ من قانون حقوق الطفل على أن تجرى محاكمة الحدث بصورة سرية ولا يجوز أن يحضر محاكمة الحدث إلا أقاربه والشهود والمحامون والمراقبون الاجتماعيون كما يحظر نشر اسم وصورة الحدث أو نشر وقائع المحاكمة أو ملخصها في أي وسيله من وسائل النشر.

48. In article 2 of the Children's Rights Act No. 45 of 2002, the definition of a child is given as " any person under the age of 18, unless he or she reaches his or her majority earlier " .
48- يعرف الطفل في المادة 2 ي من قانون حقوق الطفل رقم 45 لعام 2002 بأنه " كل إنسان لم يتجاوز ثماني عشرة سنة من عمره ما لم يبلغ سن الرشد قبل ذلك " .

123. Article 131 of the Children's Rights Act stipulates: " Trials of young persons shall be conducted in camera and may be attended only by the relatives of the defendant, the witnesses, the lawyers and social workers " .
123- نصت المادة 131 من قانون حقوق الطفل على أنه " تجري محاكمة الحدث بصورة سرية ولا يجوز أن يحضر محاكمة الحدث إلا أقاربه والشهود والمحامون والمراقبون الاجتماعيون " .

114. The Yemeni legislature devotes special attention to the issue of child protection. For example, in part VII of the Children's Rights Act, social provisions on welfare for children are set out under five titles, namely, children's nurseries, alternative care, children's care and rehabilitation, young persons' care and rehabilitation, and juvenile judges.
115- اهتم المشرع اليمني في مجال حماية الطفل ففي الباب السابع من قانون حقوق الطفل تم تنظيم الرعاية الاجتماعية للطفل عبر خمسة فصول هي دور الحضانة، و الرعاية البديلة ورعاية الطفل المعاق وتأهيله، رعاية وتأهيل الأحداث، وقضاء الأحداث.

57. The Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict was ratified pursuant to Act No. 19 of 2004. Article 149 of the Children's Rights Act also affirms that: " The State shall endeavour to respect the rules of international law relating to armed conflict and to protect children in armed conflict by:

Article 9 of the Children's Rights Act provides that " Nothing in this Act shall be deemed to infringe children's entitlement to the enjoyment of all public rights and freedoms and the protection and welfare guaranteed under the Constitution and legislation in force for individuals in general and for children in particular, without discrimination on the basis of race, colour or creed. "
400- نصت المادة 9 من قانون حقوق الطفل على أن " لا تخل أحكام هذا القانون بحق الطفل في التمتع بكافة الحقوق والحريات العامة وأوجه الحماية والرعاية التي تكفلها القوانين النافذة للإنسـان عامة وللطفل خاصة دون تمييز بسبب الجنس أو اللون أو المعتقد " .

19. The Global Initiative to End All Corporal Punishment of Children (GIEACPC) noted that corporal punishment of children is lawful in the home, that article 146 of the Children's Rights Act (2002) confirms the " legislative rights of parents to discipline their children " and that laws against violence and abuse are not interpreted as prohibiting corporal punishment in childrearing.
19- ولاحظت المبادرة العالمية لإنهاء كافة أشكال العقاب البدني للطفل أن العقاب الجسدي للطفل مشروع في المنزل، وأن المادة 146 من قانون حقوق الطفل (2002) تؤكد " حقوق الآباء المشروعة في تأديب أطفالهم " وأن القوانين المناهِضة للعنف والاعتداء لا تُفسَّر على أنها تحظر العقاب البدني في تربية الأطفال.

24. Under article 6 of the Children's Rights Act, a fine of YRIs 5,000 will be imposed on anyone who breaches article 134 of the Act, which reads as follows: " Employers who take on children shall conclude contracts with them using the standard labour contracts drawn up by the Ministry. "
24- فرضت المادة 6 من قانون حقوق الطفل غرامة مالية قدرها خمسون ألف ريال على كل من خالف أحكام المادة 134 التي تنص على ما يلي " على صاحب العمل الذي يشغل أطفالا لديه إبرام عقود معهم وفقاً لنماذج عقود العمل المعدة من قبل الوزارة " .

53. According to article 133 of the Children's Rights Act, a working child must be no younger than 14 years of age. Persons under that age are prohibited from working. Yemen has ratified the ILO Minimum Age Convention, 1973 (No. 138) and the ILO Worst Forms of Child Labour Convention, 1999 (No. 182).
53- وقد أكدت المادة 133 من قانون حقوق الطفل على أن الطفل العامل هو من بلغ 14 سنة، ويحظر عمل من هم دون ذلك السن، وقد صادقت اليمن على اتفاقيتي منظمة العمل الدولية رقم 138(1973) بشأن الحد الأدنى لسن الاستخدام ورقم 182(1999) بشأن حظر أسوأ أشكال عمل الأطفال والإجراءات الفورية للقضاء عليه.

Article 9 of the Children's Rights Act stipulates: " The provisions of this Act shall not prejudice the right of children to enjoy all public rights and freedoms, together with the protection and care which the laws in force guarantee to human beings in general and children in particular, without distinction as to sex, colour or creed. "
246- نصت المادة 9 من قانون حقوق الطفل على أن: " لا تخل أحكام هذا القانون بحق الطفل في التمتع بكافة الحقوق والحريات العامة وأوجه الحماية والرعاية التي تكفلها القوانين النافذة للإنسـان عامة وللطفل خاصة دون تمييز بسبب الجنس أو اللون أو المعتقد " .

195. Article 9 of the Children's Rights Act stipulates: " The provisions of this Act shall not prejudice the right of children to enjoy all public rights and freedoms, together with the protection and care which the laws in force guarantee to human beings in general and children in particular, without distinction as to sex, colour or creed. "
195- كما نصت المادة 9 من قانون حقوق الطفل على " لا تخل أحكام هذا القانون بحق الطفل في التمتع بكافة الحقوق والحريات العامة وأوجه الحماية والرعاية التي تكفلها القوانين النافذة للإنسان عامة وللطفل خاصة دون تمييز بسبب الجنس أو اللون أو المعتقد " .

Article 49 of the Civil Status and Civil Registration Act provides that every citizen of the Republic of Yemen, upon reaching the age of 16 years, shall be issued a personal identity card, or a family identity card if he is the head of a family. Article 11 of the Children's Rights Act provides that every child is entitled to citizenship in accordance with the terms of the Act and other applicable legislation.
352- وأقر قانون الأحوال المدنية والسجل المدني في المادة 49 بأنه يجب على كل شخص من مواطني الجمهورية اليمنية متى بلغ السادسة عشر من عمره أن يحصل على بطاقة شخصية أو بطاقة عائلية إذا أصبح رب أسره، وأكدت المادة 11 من قانون حقوق الطفل أن لكل طفل الحق بأن يكون لـه جنسية وفقاً لأحكام هذا القانون والقوانين النافذة.

Article 49 of the Civil Status and Civil Register Act requires every citizen of the Republic of Yemen, upon reaching the age of 16, to obtain a personal identity card or a family card, if that person is the head of a family. Article 11 of the Children's Rights Act affirms that every child is entitled to a nationality under the Act and the laws in force.
276- وأقر قانون الأحوال المدنية والسجل المدني في المادة 49 بأنه يجب على كل شخص من مواطني الجمهورية اليمنية متى بلغ السادسة عشر من عمره أن يحصل على بطاقة شخصية أو بطاقة عائلية إذا أصبح رب أسرة، وأكدت المادة 11 من قانون حقوق الطفل أن لكل طفل الحق بأن يكون لـه جنسية وفقاً لأحكام هذا القانون والقوانين النافذة.

97. Article 161 of the Children's Rights Act prescribes a fine of YRIs 50,000 for any breach of article 134 of the Act. The article states that employers must conclude contracts with children in their employ using the model contracts prepared by the Ministry of Labour (Ministry of Social Affairs and Labour).
97- جاء في المادة 161 من قانون حقوق الطفل على أنه " يعاقب بغرامة مالية قدرها خمسون ألف ريال كل من خالف المادة 134 من هذا القانون، والتي نصت على صاحب العمل الذي يشغِّل أطفالاً لديه إبرام عقود معهم وفقاً لنماذج عقود العمل المعدة من قبل الوزارة (وزارة الشؤون الاجتماعية والعمل) " .

16. Article 163 of the Children's Rights Act states that, without prejudice to any higher penalty laid down in any other law, a term of up to 10 years' imprisonment shall be imposed on anyone who incites a male or female child to engage in debauchery or prostitution.
16- وعاقب قانون حقوق الطفل في المادة 163 منه على أنه مع عدم الإخلال بأي عقوبة أشد منصوص عليها في أي قانون آخر يعاقب بالحبس مدة لا تزيد عن عشر سنوات كل من حرض طفلاً ذكراً كان أو أنثى على ممارسة الفجور والدعارة.
