4. The provisions of paragraphs 1, 2 and 3 of this article apply whether or not the arbitral, judicial or similar proceedings relate to the dispute that is or was the subject matter of the conciliation proceedings.
4- تنطبق أحكام الفقرات 1 و 2 و 3 من هذه المادة سواء أكانت أم لم تكن الإجراءات التحكيمية أو القضائية أو الإجراءات المماثلة تتعلق بالنـزاع الذي يشكل، أو كان يشكل، موضوع إجراءات التوفيق.

They may also by mutual agreement request his assistance to resolve any other difficulty that they may encounter in reaching an agreement on the modalities of the conciliation proceedings.
وللدولتين أيضا أن تطلبا مساعدة اﻷمين العام، بموجب اتفاق متبادل، في تذليل أية مصاعب أخرى قد تنشأ في سبيل التوصل إلى اتفاق بشأن الطرائق التي تستخدم في إجراءات التوفيق.

" (f) A document prepared solely for purposes of the conciliation proceedings.
" (و) وثيقة أُعدت لأغراض إجراءات التوفيق فحسب.

" (4) The provisions of paragraphs (1), (2) and (3) of this article apply whether or not the arbitral, judicial or similar proceedings relate to the dispute that is or was the subject matter of the conciliation proceedings.
" (4) تُطبّق أحكام الفقرات (1) و (2) و (3) من هذه المادة سواء أكانت أم لم تكن الإجراءات التحكيمية أو القضائية أو الإجراءات المماثلة تتعلق بالنـزاع الذي يشكل، أو شكل، موضوع إجراءات التوفيق.

" 1. Except where necessary for preserving its rights, neither of the parties shall initiate, during the conciliation proceedings, any arbitral or judicial proceedings in respect of the dispute which is the subject of the conciliation proceedings.
" ١ - لا يجوز ﻷي من الطرفين، في أثناء اجراءات التوفيق، البدء في إقامة دعوى قضائية أو في اجراءات تحكيميـــة أو بخصوص النزاع، الذي هو موضع اجراءات التوفيق ما لم يقتضي حفظ الحقوق خلاف ذلك.

[Variant 2] The parties may agree not to initiate, during the conciliation proceedings, any arbitral or judicial proceedings in respect of a dispute that is the subject of the conciliation proceedings.
]البديل 2[ يجوز أن يتفق الطرفان على أن لا تستهل، أثناء اجراءات التوفيق، أي اجراءات تحكيمية أو قضائية فيما يتعلق بنزاع هو موضوع اجراءات التوفيق.

" The parties undertake not to rely on or introduce as evidence in arbitral or judicial proceedings, whether or not such proceedings relate to the dispute that is the subject of the conciliation proceedings:
" يتعهد الطرفان بعدم الاعتماد على ما يلي ، أو استخدامه في أي اجراءات تحكيمية أو قضائية ، سواء أكانت هذه الاجراءات متصلة بالنزاع الذي هو موضوع اجراءات التوفيق أم لم تكن :

(b) Admissions made by the other party in the course of the conciliation proceedings;
)ب( اقرارات الطرف اﻵخر أثناء اجراءات التوفيق ؛

Such misunderstanding might arise if paragraph (3) was construed as applying not only to the conduct of the conciliation proceedings but also to the result of such proceedings, i.e., the settlement agreement.
وقيل ان اساءة الفهم تلك قد تنشأ اذا فُسّرت الفقرة (3) بأنها تنطبق لا على تسيير اجراءات التوفيق فحسب بل وكذلك على نتيجة تلك الاجراءات، أي على اتفاق التسوية.

It was agreed that the Guide should make it clear that paragraph (3) was intended to govern the conduct of the conciliation proceedings and that it did not address the contents of the settlement agreement.
واتفق على أن يوضح الدليل أن المقصود بالفقرة (3) هو أن تحكم تسيير اجراءات التوفيق وأنها لا تتناول مضمون اتفاق التسوية.

The main idea of the paragraph is to allow the parties the possibility of termination of the conciliation proceedings if any indiscretion has occurred.
فالهدف اﻷساسي للفقرة هو السماح للطرفين بإمكانية انهاء عملية التوفيق في حال أي خروج عن واجب الكتمان.
