According to the State party, the Committee did not take note of its comments of 22 April 2002, in violation of the procedural guarantees offered by article 5 of the Optional Protocol and rule 94 of the Committee's rules of procedures.

7.1 Before considering any claims contained in a communication, the Committee on the Rights of Persons with Disabilities must decide, in accordance with article 2 of the Optional Protocol and rule 65 of the Committee's rules of procedure, whether or not it is admissible under the Optional Protocol.

1.2 On 13 July 2011, pursuant to article 5 (1) of the Optional Protocol and rule 63 of its rules of procedure, the Committee requested the State party to refrain from expelling the author to Uganda while her communication was under consideration by the Committee.

2. Communications submitted by or on behalf of individuals or groups of individuals who are subject to the jurisdiction of a State party to the Convention and the Optional Protocol shall be subject to the provisions contained in articles 1 and 2 of the Optional Protocol and rule 55 et seq. of the Committee's rules of procedure.

5.1 On 12 February 2009, the Committee, pursuant to article 5, paragraph 1, of the Optional Protocol and rule 63 of its rules of procedure, requested the State party to take such appropriate and concrete interim measures of protection in favour of the author and her children as may be required to avoid irreparable damage to them while their communication is under consideration by the Committee.

First, it alleged that the author did not exhaust domestic remedies, as required by article 2 of the Optional Protocol and rule 90 (f) of the Committee's rules of procedure.
أولاً، زعمت أن صاحب البلاغ لم يستنفد سبل الانتصاف المحلية، كما تقضي بذلك المادة 2 من البروتوكول الاختياري والمادة 90(و) من النظام الداخلي للجنة.

8.1 The Committee on the Rights of Persons with Disabilities has considered this communication in the light of all the information that it has received, in accordance with article 5 of the Optional Protocol and rule 73, paragraph 1, of the Committee's rules of procedure.

1.2 When registering the communication on 7 October 2011, and pursuant to article 5 (1) of the Optional Protocol and rule 63 of its rules of procedure, the Committee requested the State party to refrain from expelling the author to Burundi while her communication was under consideration by the Committee.
1-2- وعند تسجيل البلاغ بتاريخ 7 تشرين الأول/أكتوبر 2011 طلبت اللجنة إلى الدولة الطرف، عملاً بالمادة 5 (1) من البروتوكول الاختياري والمادة 63 من نظامها الداخلي، عدم طرد صاحبة البلاغ إلى بوروندي خلال الفترة التي يكون فيها بلاغها قيد نظر اللجنة.
