On 17 February 2013, the Permanent Military Tribunal of the Royal Armed Forces in Rabat had pronounced its verdict in the trial of 25 Saharan civilians in relation to violence during and after the dismantling of the Gdim Izik protest camp near Laayoune in November 2010 (see paras. 19, 20 and 21).

This court is competent to rule on crimes committed by members of the military in the course of their duties under the Military Justice Act (desertion, mutiny, etc.) and crimes they have committed under the Criminal Code (murder, theft, etc.), as well as criminal cases perpetrated by civilians against members of the Royal Armed Forces or against the external security of the State.
68- تختص هذه المحكمة في الفصل في الجرائم التي يرتكبها العسكريون بمناسبة قيامهم بمهامهم في إطار قانون العدل العسكري (الهروب من الجندية، التمرد، الخ) أو الجرائم المرتبكة من طرفهم في إطار القانون الجنائي (القتل، والسرقة وغيرها)، إضافة إلى النظر في القضايا الجنائية التي يقترفها أشخاص مدنيون ضد أفراد القوات المسلحة الملكية وضد أمن الدولة الخارجي.

In the case in hand, Mustapha Adib, in a letter addressed to the Moroccan authorities and to the international community to protest against his conviction and detention, recognizes that Moroccan military personnel, under the regulations of the Royal Armed Forces, are generally forbidden to publish.

11. The source adds that, in a judgement on 17 February 2000, the Permanent Tribunal of the Royal Armed Forces found Captain Adib guilty of a violation of military rules and contempt of the army, on the basis of articles 159 and 178 of the Code of Military Justice.

In its reply, the Government merely recalled the facts which had led to Mustapha Adib's conviction for violating military rules and contempt of the army by the Permanent Tribunal of the Royal Armed Forces, and the various trials which had led to his last sentence of two and a half years' imprisonment.
