In the absence of information from the Government, the Special Rapporteur is disposed to consider that the allegations of torture and cruel and inhuman treatment and punishment of Iraqi refugees described above may be well founded.

(21) ويساور اللجنة أيضاً قلق شديد لما تلقته من ادعاءات تتصل بأفعال التعذيب والمعاملة القاسية واللاإنسانية وحالات الإعدام بإجراءات موجزة وعمليات الاختطاف التي ارتكبتها جماعات المعارضة المسلحة.

(a) Widespread use of torture and cruel and inhuman treatment of detainees, individuals suspected of having participated in demonstrations, journalists, web bloggers, defectors of security forces, persons wounded or injured, women and children (arts. 2, 11, 13 and 16);
(أ) انتشار اللجوء إلى ممارسات التعذيب والمعاملة القاسية واللاإنسانية التي يتعرض لها المحتجزون والأفراد المشتبه بمشاركتهم في المظاهرات والصحفيون والمدونون على الإنترنت والمنشقون عن قوات الأمن والجرحى أو المصابون والنساء والأطفال (المواد 2 و11 و13 و16)؛

(b) The habitual use of torture and cruel and inhuman treatment as a tool, which appears to be deliberate and part of State's policy, to instil fear and to intimidate and terrorize civilian population (arts. 2 and 16) and the complete disregard by State party authorities of the requests from authoritative international bodies and experts to cease these violations (art. 2);
(ب) اللجوء المعتاد إلى ممارسات التعذيب والمعاملة القاسية واللاإنسانية كأداة تبدو متعمدة وجزءاً من سياسة الدولة لبث الرعب وتخويف السكان المدنيين وترويعهم (المادتان 2 و16) وتجاهل سلطات الدولة الطرف التام لطلبات الهيئات الدولية الرسمية والخبراء الدوليين بوقف تلك الانتهاكات (المادة 2)؛
