The Law on Confirmation of Convention on compensation for victims of violent crime ( " Official Gazette of the Republic of Montenegro " - International Treaties, issue 6/09) was put into effect in Montenegro on the 1st of July, 2010.

350. The Law on Social and Child Protection (Official Gazette of the Republic of Montenegro 78/05) prescribes the right to family cash benefit as a welfare benefit for a family in the state of social need.
350- ينص قانون الحماية الاجتماعية وحماية الطفل (الجريدة الرسمية لجمهورية الجبل الأسود 78/2005) على حق الأسرة في الحصول على إعانة نقدية كإعانة اجتماعية لأسرة في حالة حاجة اجتماعية.

352. The Law on Social and Child Protection ( > > Official Gazette of the Republic of Montenegro 78/05) prescribes that a family i.e. family member may exercise the right to family cash benefit in the event of:

358. Women with disabilities exercise the rights in the area of social and child protection pursuant to the Law on Social and Child Protection (Official Gazette of the Republic of Montenegro 78/05).
358- وتمارس النساء ذوات الإعاقة الحقوق في مجال الحماية الاجتماعية وحماية الطفل وفقاً لقانون الحماية الاجتماعية وحماية الطفل (الجريدة الرسمية لجمهورية الجبل الأسود 78/2005).

Domestic violence is a serious problem in modern societies, therefore a growing number of legislations, including ours (Article 220 of the Criminal Code, Official Gazette of the Republic of Montenegro 47/06), include this criminal offence. The criminal offence has its basic form (paragraph 1), three serious forms (par. 2 - 4) and a special form (paragraph 5).
ويشكّل العنف المنزلي مشكلة كبيرة في المجتمعات الحديثة، ولذلك فإن عدداً متزايداً من التشريعات، بما فيها تشريعاتنا، ينص على هذه الجريمة (المادة 220 من المدونة الجنائية، الجريدة الرسمية للجبل الأسود 47/2006)، وتتخذ هذه الجريمة شكلاً أساسياً (الفقرة 1)، وثلاثة أشكال جسيمة (الفقرات 2-4)، وشكلاً خاصاً (الفقرة 5).

A report of the psychiatric facility must include a decision of a psychiatrist on forced confinement accompanied with appropriate documentation, in accordance with the Law on Protection and Exercise of Rights of Mentally Ill Persons (Official Gazette of the Republic of Montenegro 32/05).
106- ويجب أن يتضمن تقرير مرفق الطب النفسي قرارا من الطبيب النفسي بشأن الإيداع القسري مشفوعاً بالمستندات المناسبة، وفقاً للقانون المتعلق بحماية وممارسة حقوق الأشخاص المرضى عقلياً (الجريدة الرسمية لجمهورية الجبل الأسود 32/05).

62. The Law on Courts (Official Gazette of the Republic of Montenegro 5/02, 49/04 and Official Gazette of Montenegro 22/08) stipulates that everyone shall have the right to address the court in order to exercise their right and that everyone shall be equal before the court (Article 5).
62- وينص قانون المحاكم (الجريدة الرسمية لجمهورية الجبل الأسود 5/2002، و49/2004، والجريدة الرسمية لجمهورية الجبل الأسود 22/2008) على أن لكل الناس الحق في المثول أمام المحاكم من أجل ممارسة حقوقهم، وأن الجميع سواسية أمام المحاكم (المادة 5).

67. The Law on Media (Official Gazette of the Republic of Montenegro 51/02 and 62/02) prohibits publication of information and opinions which incite discrimination, hatred or violence against persons or group of persons because of their belonging or not belonging to a certain race, religion, nation, ethnic group, sex or sexual orientation (Article 23).
67- ويحظر قانون وسائط الإعلام (الجريدة الرسمية لجمهورية الجبل الأسود 51/2002 و62/2002) نشر معلومات وآراء تحض على التمييز أو الكراهية أو العنف ضد أشخاص أو مجموعات من الأشخاص بسبب انتمائهم أو عدم انتمائهم إلى عنصر أو دين أو وطن أو جماعة إثنية أو جنس أو ميل جنسي معينين (المادة 23).

68. The Law on Minority Rights and Freedoms (Official Gazette of the Republic of Montenegro 31/06 and 38/07) guarantees equality between minorities and other citizens of Montenegro, prescribes that they enjoy equal legal protection and that any violation of minority rights shall be in breach of law and punishable (Article 4).
68- ويضمن قانون حقوق وحريات الأقليات (الجريدة الرسمية لجمهورية الجبل الأسود 31/2006 و38/2007) المساواة بين الأقليات ومواطني الجبل الأسود الآخرين، وينص على تمتعهم بالحماية القانونية على قدم المساواة وعلى أن أي انتهاك لحقوق الأقليات يعتبر انتهاكاً للقانون ويخضع للعقوبات (المادة 4).

69. The Law on Asylum (Official Gazette of the Republic of Montenegro 45/06) stipulates that asylum seeker shall be entitled to communicate with the person in official capacity and interpreter of the same sex and that asylum seeker shall in all stages of the procedure be treated in a way that acknowledges his/her sex.
69- وينص قانون اللجوء (الجريدة الرسمية لجمهورية الجبل الأسود 45/2006) على أن من حق ملتمسي اللجوء أن يتواصلوا مع الشخص المسؤول ومع مترجم من نفس الجنس، وأن يُعامَل ملتمس اللجوء في جميع مراحل الإجراء بطريقة تعترف بجنسه.

136. The criminal offence of trafficking in human beings (Article 444 of the Criminal Code of Montenegro ) was for the first time regulated in the Criminal Law of Montenegro (Official Gazette of the Republic of Montenegro 70/03, 13/04 and 47/06).
136- أدخلت أحكام خاصة بجريمة الاتجار بالبشر (المادة 444 من المدونة الجنائية للجبل الأسود) للمرة الأولى في القانون الجنائي للجبل الأسود (الجريدة الرسمية لجمهورية الجبل الأسود 70/2003 و13/2004 و47/2006).

393. In addition to substantive family law, the Family Law (Official Gazette of the Republic of Montenegro 1/07) regulates also individual judicial and administrative procedures in legal matters pertaining to family relations - procedural family law (Articles 316 - 372, Family Law).
393- وقانون الأسرة (الجريدة الرسمية لجمهورية الجبل الأسود 1/2007)، بالإضافة إلى قانون الأسرة الموضوعي، ينظم أيضا فرادى الإجراءات القانونية والإدارية في المسائل القانونية المتعلقة بالعلاقات الأسرية - قانون الأسرة الإجرائي (المواد 316- 372 من قانون الأسرة).

56. The Law on Health Insurance (Official Gazette of the Republic of Montenegro 39/04) prescribes that mandatory health insurance is part of the system of social security of citizens which grants the right to the health care and other rights to all citizens of Montenegro and other persons on the basis of the principle of obligation, reciprocity and solidarity (Article 3).
56- وينص قانون التأمين الصحي (الجريدة الرسمية لجمهورية الجبل الأسود 39/2004) على أن التأمين الصحي الإلزامي جزء من نظام الضمان الاجتماعي للمواطنين الذي يمنح الحق في الرعاية الصحية وغير ذلك من الحقوق لجميع مواطني الجبل الأسود وغيرهم من الأشخاص على أساس مبدأ الالتزام والمعاملة بالمثل والتضامن (المادة 3).

58. The Law on Social and Child Protection (Official Gazette of the Republic of Montenegro 78/05) prescribes that citizens shall be equal in exercising their rights from the area of social and child protection regardless of their national affiliation, race, sex, language, religion, social background or other personal features (Article 5).
58- وينص قانون الحماية الاجتماعية وحماية الطفل (الجريدة الرسمية لجمهورية الجبل الأسود 78/2005) على أن المواطنين متساوون في ممارستهم لحقوقهم في مجال الحماية الاجتماعية وحماية الطفل بغض النظر عن انتمائهم الوطني أو عرقهم أو جنسهم أو لغتهم أو دينهم أو خلفيتهم الاجتماعية أو سماتهم الشخصية الأخرى (المادة 5).

The Commercial Court of Podgorica rejected the defence of the buyer that the parties had not agreed on the price of the goods because the defendant did not provide any evidence of his claims despite having the burden of proof pursuant to article 219, paragraph 3 of the Law on Civil Procedure of Montenegro ( " Official Gazette of the Republic of Montenegro " , no. 22/04 - " ZPP " ).
ورفضت محكمة الجبل الأسود التجارية دفاع المشتري بأنَّ الطرفين لم يتفقا على ثمن البضاعة، لأنَّ المدّعى عليه لم يقدّم أيَّ دليل على مزاعمه على الرغم من وقوع عبء الإثبات عليه عملا بالفقرة 3 من المادة 219 من قانون الإجراءات المدنية للجبل الأسود ( " الجريدة الرسمية لجمهورية الجبل الأسود " ، العدد 22/04 - " ZPP " ).

By the Law on the Amendments and Supplements of the Criminal Code (adopted on the 22nd of April, 2010, reported in " Official Gazette of the Republic of Montenegro " , issue 25/2010) includes the modification of the provision on human trafficking and constitutes a separate offence under this provision, which prohibits the using of a human trafficking victim's services (paragraph 4 article 444)
54- وبموجب قانون تعديلات وإضافات القانون الجنائي (المعتَمد في 22 نيسان/ أبريل 2010 والمنشور في " الجريدة الرسمية لجمهورية الجبل الأسود " ، العدد 25/2010) أصبح القانون يشمل تعديل الحكم الخاص بالاتجار بالبشر ليشكِّل جريمة منفصلة بموجب هذا الحكم، الذي يحظر استعمال خدمات ضحايا الاتجار بالبشر (الفقرة 4 من المادة 444).
