441. Nothing in this article shall prejudice the trial and punishment of any persons for any act or omission which, at the time when it was committed, was criminal according to the general principles of law recognized by the community of nations.
442- ليس في هذه المادة من شيء يخل بمحاكمة ومعاقبة أي شخص على أي فعل أو امتناع عن فعل كان حين ارتكابه يشكل جرما وفقا لمبادئ القانون العامة التي تعترف بها جماعة الأمم.

٣٨- بمقتضى قانون نيبال لا يدان أي فرد بأية جريمة جنائية بسبب فعل أو امتناع عن فعل لم يكن وقت ارتكابه يشكل جريمة جنائية بمقتضى القانون.

91. Article 15 of the Covenant states that, a person shall not be held guilty of a criminal offence on account of any act or omission which was not an offence at the time that it was committed, but this should not prejudice the trial and punishment of a person for an act or omission committed which was criminal according to international law.
١٩- تنص المادة ١٥ من العهد على ألا يُدان أي فرد بأي جريمة بسبب فعل أو امتناع عن فعل لم يكن وقت ارتكابه يشكل جريمة، على ألا يخل ذلك بمحاكمة ومعاقبة أي شخص على أي فعل أو امتناع عن فعل كان يشكل جرما وفقا للقانون الدولي.

272. Article 34 (4) of the Constitution provides that no person is to be held guilty of a criminal offence on account of any act or omission which did not constitute a criminal and punishable offence under a law that has been in existence prior to this Act.
272- ينص الدستور في المادة 34(4) منه على عدم توجيه الاتهام لأي شخص بسبب فعل أو امتناع عن فعل ما لم يكن ذلك الفعل أو الامتناع يشكل جريمة عند وقوعه وفقاً لقانون سابق يجرمه ويعاقب عليه.

“No person shall be held to be guilty of a criminal offence on account of any act or omission which did not, at the time it took place, constitute such an offence, and no penalty shall be imposed for any criminal offence which is severer in degree or description than the maximum penalty which might have been imposed for that offence at the time when it was committed.”
