The Committee draws the attention of the State party to its general recommendation 30 on non-citizens and recommends that it ensure that all persons entitled to refugee status under the Convention relating to the Status of Refugees be granted such status.

The issue of disability was only raised during the thematic discussion held in 2004 by CERD on " Non-citizens and racial discrimination " by one of the participants, who referred to the simplified naturalization process introduced for certain categories of aliens, including persons with disabilities, by the Government of Estonia.

The Committee recalls that State parties have the duty to ensure that legislative guarantees against racial discrimination apply to non-citizens regardless of their immigration status, and that the implementation of legislation does not have a discriminatory effect on non-citizens.

In this context, the Committee draws the attention of the State party to General Recommendation XI on non-citizens and the obligation to report fully upon legislation concerning foreigners and its implementation.
وفي هذا الصدد، تسترعى اللجنة انتباه الدولة الطرف إلى التوصية العامة الحادية عشرة المتعلقة بغير المواطنين وبالالتزام بتقديم معلومات كاملة عن التشريع الخاص بالأجانب وتنفيذه.

At its sixty-fourth session, in March 2004, the Committee had held a thematic discussion on non-citizens and racial discrimination, as a result of which it had adopted a general recommendation proposing that States parties should adopt a number of measures in that area.
وأضاف أن اللجنة قامت في دورتها الرابعة والستين في آذار/مارس 2004 بإجراء مناقشة موضوعية بشأن غير المواطنين والتفرقة العنصرية، وفي نهاية المناقشة اتخذت توصية عامة دعت فيها الدول الأطراف إلى اتخاذ سلسلة من التدابير في هذا الصدد.

The Committee recommends that the State party guarantee equal rights and freedom from discrimination, including under article 161 of the Criminal Code, to all persons subject to its jurisdiction with the aim of avoiding ambiguity in ensuring protection to all persons, in accordance with general recommendation No. 30 (2004) on non-citizens.

The Committee draws the attention of the State party to general recommendation 30 on non-citizens (2004), and requests the State party to adopt a legislative protection framework for refugees and to remove obstacles that prevent the enjoyment of refugees of economic, social and cultural rights, notably in the areas of education, employment and health.

The Committee also examined the situation of several States parties under its early warning and urgent procedures (see chapter II). In order to continue its consideration of subjects of general interest, the Committee decided at its sixty-third session that it would hold a thematic discussion on non-citizens and non-discrimination at its sixty-fourth session, to be held from 23 February to 12 March 2004.

While it remains accepted for States to impose certain restrictions on non-citizens concerning the right to vote and to be elected, such restrictions should not be applied more widely than necessary.
وبينما لا يزال هناك من يقبل بأن تفرض الدولة بعض القيود على غير المواطنين فيما يتعلق بالحق في التصويت وفي الترشُّح، فإن هذه القيود ينبغي ألا تطبق على نطاق أوسع مما هو ضروري.
