These elements include a clear definition of intent, of aggravating circumstances, of attempted torture, of acts of torture committed to intimidate or coerce a person or a third person and of acts of torture committed by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.

With respect to the Convention Against Torture, it must be noted that the definition in articles 1(1) and 16 of CAT stipulates that the act must have been committed " by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity " .
