The articles of this section apply when part or parts of the territory of a State separate from that State and form one or more successor States while the predecessor State continues to exist.

This is obvious at first glance, given that the transfer of part of the territory of a State is governed by just one article, article 20, whereas three articles, articles 24, 25 and 26, apply to the separation of part or parts of the territory of a State.

Notwithstanding article 3, which stipulates that the articles on nationality of natural persons in relation to the succession of States apply only to the effects of a succession of States occurring in conformity with international law, the criteria to be used for the determination of conformity with international law of cases of separation of part or parts of the territory of a State are uncertain.

When part or parts of the territory of a State separate from that State and form one or more successor States while the predecessor State continues to exist, a successor State shall, unless otherwise indicated by the exercise of a right of option, attribute its nationality to:

In cases of the dissolution of a State, or when part or parts of the territory of a State separated and formed one or more successor States, the draft articles envisaged the attribution of nationality by the successor State or States on the grounds of habitual residence or an appropriate legal connection with a constituent unit of the predecessor State that had become part of the successor State.
وفي حالة انحلال الدولة أو انفصال جزء أو أجزاء من إقليم الدولة وتشكيلها دولة خلفا أو عدة دول خلف، فإن منح جنسية الدولة أو الدول الخلف يتم بتطبيق معايير اﻹقامة الاعتيادية أو الصلة القانونية المناسبة بإحدى الوحدات المكونة للدولة السلف التي أصبحت جزءا من الدولة الخلف.
