3. Pending any action by the Council, the Secretary-General shall take such immediate measures of a temporary nature as are practical and reasonable in the circumstances to prevent, contain and minimize serious harm or the threat of serious harm to the marine environment.

3. Pending any action by the Council, the Secretary-General shall take such immediate measures of a temporary nature as are practical and reasonable in the circumstances to prevent, contain and minimize serious harm or the threat of serious harm to the marine environment.

4. After having received the report of the Secretary-General, the Commission shall determine, based on the evidence provided to it and taking into account the measures already taken by the contractor, which measures are necessary to respond effectively to the incident in order to prevent, contain and minimize serious harm or the threat of serious harm to the marine environment, and shall make its recommendations to the Council.
4 - تقرر اللجنة بعد تلقيها تقرير الأمين العام، مستندة إلى الأدلة الموفرة لها، وآخذة في الاعتبار التدابير التي سبق أن اتخذها المتعاقد، التدابير الضرورية للتصدي بفعالية للحادث بغية اتقاء الضرر الجسيم بالبيئة البحرية أو خطر إلحاق ضرر جسيم بها واحتوائه وتخفيفه إلــى أقصى حـــد، وتقدم توصياتها إلى المجلس.

7. If a contractor does not promptly comply with an emergency order to prevent, contain and minimize serious harm or the threat of serious harm to the marine environment arising out of its activities in the Area, the Council shall take by itself or through arrangements with others on its behalf, such practical measures as are necessary to prevent, contain and minimize any such serious harm or threat of serious harm to the marine environment.
7 - إذا لم يمتثل المتعاقد، على وجه السرعة، للأمر الصادر في حالة الطوارئ لاتقاء الضرر الجسيم بالبيئة البحرية أو خطر إلحاق ضرر جسيم بها جراء الأنشطة المضطلع بها في المنطقة واحتوائه وتخفيفه إلــى أقصى حـــد، يجوز للمجلس أن يتخذ، بنفسه أو من خلال ترتيبات مع آخرين، نيابة عنه، التدابير التي يراها ضرورية لاتقاء الضرر الجسيم بالبيئة البحرية أو خطر إلحاق ضرر جسيم بها واحتوائه وتخفيفه إلــى أقصى حـــد.

6.3 The Contractor shall comply with emergency orders issued by the Council and immediate measures of a temporary nature issued by the Secretary-General in accordance with the Regulations, to prevent, contain, minimize or repair serious harm or the threat of serious harm to the marine environment, which may include orders to the Contractor to immediately suspend or adjust any activities in the exploration area.
6-3 يمتثل المتعاقد للأوامر التي يصدرها المجلس في حالات الطوارئ ولأي تدابير فورية ذات طابع مؤقت يصدرها الأمين العام وفقا للنظام لاتقاء الضرر الجسيم بالبيئة البحرية أو خطر إلحاق ضرر جسيم بها واحتوائه وتخفيفه إلــى أقصى حـــد وإصلاحه، ويمكن أن تشمل أوامر تصدر إلى المتعاقد ليقوم على الفور بتعليق أو تعديل أية أنشطة في قطاع الاستكشاف.

6.4 If the Contractor does not promptly comply with such emergency orders or immediate measures of a temporary nature, the Council may take such reasonable measures as are necessary to prevent, contain, minimize or repair any such serious harm or the threat of serious harm to the marine environment at the Contractor's expense.
6-4 في حالـة عدم امتثال المتعاقد على الفور للأوامر التي تصدر في حالات الطوارئ أو التدابير الفورية ذات الطابع المؤقت، يجوز للمجلس أن يتخذ، على نفقة المتعاقد، التدابير المعقولة اللازمة لاتقاء الضرر الجسيم بالبيئة البحرية أو خطر إلحاق ضرر جسيم بها أو احتواء ذلك الضرر أو تخفيفه إلــى أقصى حـــد أو إصلاحه.

4. 6-3 على المتعاقد الامتثال للأوامر التي يصدرها المجلس في حالات الطوارئ ولأي تدابير فورية ذات طابع مؤقت يصدرها الأمين العام وفقا للنظام لمنع إلحاق ضرر جسيم بالبيئة البحرية، أو خطر إلحاق ضرر جسيم بها، ولاحتواء ذلك الضرر، أو الخطر، وتخفيفه إلــى أدنى حـــد ممكن وإصلاح الحالة، ويمكن أن تشمل أوامر تصدر إلى المتعاقد ليقوم على الفور بتعليق أو تعديل أية أنشطة في قطاع الاستكشاف.

6-4 في حالــــة عـــدم امتثال المتعاقد على الفور للأوامر التي تصدر في حالات الطوارئ أو التدابير الفورية ذات الطابع المؤقت، يجوز للمجلس أن يتخذ، على نفقة المتعاقد، الإجراءات المعقولة اللازمة لمنع إلحاق ضرر جسيم بالبيئة البحرية، أو خطر إلحاق ضرر جسيم بها، ولاحتواء ذلك الضرر، أو الخطر، وتخفيفه إلــى أدنى حـــد ممكن وإصلاح الحالة.
