In order to carry out the measures referred to in this article, each State Party shall empower its courts or other competent authorities to order that bank, financial or commercial records be made available or be seized. A State Party shall not decline to act under the provisions of this paragraph on the ground of bank secrecy (1988 Convention, article 5, paragraph 3).
٣- بغية تنفيذ التدابير المشار إليها في هذه المادة، تخول كل دولة طرف محاكمها أو غيرها من سلطاتها المختصة أن تأمر بتقديم السجلات المصرفية أو المالية أو التجارية أو بالتحفظ عليها، وليس لدولة طرف أن ترفض العمل بموجب أحكام هذه الفقرة بحجة سرية العمليات المصرفية )الفقرة ٣ من المادة ٥ من اتفاقية عام ٨٨٩١(.
