Text of the resolution: States shall: " Take appropriate measures in conformity with relevant provisions of national and international law, including international standards of human rights, before granting refugee status, for the purpose of ensuring that the asylum-seeker has not planned, facilitated or participated in the commission of terrorist acts; "

109. On the question of the reference to participation contained in the phrase “participated in the commission of”, while some preferred that it be replaced with “committed”, others supported its retention.

Thus, when examining future applications for refugee status, the Ministry will take due account of paragraph 3 of Security Council resolution 1373 (2001) and, in particular, will take all available measures to ensure that " the asylum-seeker has not planned, facilitated or participated in the commission of terrorist acts " .

1. Each State Party shall take the necessary measures to ensure that legal entities located or having their registered offices in its territory may be held liable when they have knowingly, through the agency of one or more persons responsible for their management or control, derived profits from or participated in the commission of offences referred to in this Convention.
١ - تتخذ كل دولة طرف التدابير اللازمة لكفالة جواز محاسبة الكيانات الاعتبارية التي توجد أو يوجد مكتبها الرئيسي في إقليم تلك الدولة إذا حصلت، بعِلم تام من شخص أو عدة أشخاص مسؤولين عن إدارتها أو تسييرها، على أرباح من الجرائم المشار إليها في هذه الاتفاقية أو شاركت في ارتكابها.

1. 19. In line with the trends identified in previous thematic reports, a number of States parties had taken measures to encourage cooperation with law enforcement authorities of persons who participated in the commission of corruption offences.

Specifically with regard to persons who have participated in the commission of crimes and provide assistance to the law enforcement authorities, the prosecutor is entitled to release such persons from criminal responsibility if their assistance was provided prior to the commencement of the investigation.

This section sets the liability for the establishment of a criminal organisation, providing that not only persons who have established, lead or participated in the commission of especially serious crimes against State interests, but also persons who are aware of a criminal organisation's goals and intentionally involve themselves in this organisation or in its substructures, shall be liable in accordance with this Section.
