1A Internationality: Parties' places of business in different States

1. This Convention applies to the use of electronic communications in connection with the formation or performance of a contract between parties whose places of business are in different States.

Although the contract was silent as to governing law, both parties had their places of business in countries that had adopted the CISG, therefore the Arbitral Tribunal deemed the CISG applicable.
