27. Mr. SREENIVASAN (India), speaking on a point of order, said that, since the text of draft resolution A/C.3/49/L.32 was the only text that had been circulated and since the deadline for submitting draft resolutions had passed, there could be no revised text.

Mr. WALLACE (United States of America) felt that the comment on article 41 bis in point 21, paragraph 2, of the draft amendments, put forward some ideas which were certainly interesting, such as the concept of " value threshold " , but which were not covered by the Model Law. He would like the text of the draft amendments to reflect that of the Model Law as closely as possible.

That change was thought to be useful by members of the Committee, especially members from developing countries, to make clear in the text of article 26 a point that already was clear in the commentary and was implicit in the language of the last sentence of prior paragraph 1, now revised and moved to paragraph 6.

Mr. CHTCHERBAK (Russian Federation) was glad that certain obsolete provisions, such as those on apartheid and South Africa, had been removed from the draft resolution on foreign economic interests. His delegation nevertheless remained concerned by the unilateral and biased cast of the draft resolution and by the lack of balance in the text, as the activities of foreign economic interests were presented only from a negative point of view.

Mr. GONZALEZ (France), clarifying his delegation's position, said that the text in question could not be formally adopted; therefore, it would be necessary either to refer the matter to the Sixth Committee or make a recommendation on the procedure to be followed. Hence, his statement was not intended to record reservations, but to point out that formally, it would be impossible to proceed as the Chairman had suggested.

Also, the second comment that has been made here - whether those who have said that they are perhaps not in a position at this point to agree to the text as it exists right now in the Presidential draft decision because we do not agree with the work to be done in nuclear disarmament, NSA and PAROS - is totally misplaced.

Secondly, with respect to the text itself, there have been some implications that there is perhaps something new in it or that it requires further study. I make the very obvious point that this text bears the symbol A/C.1/50/L.3. It is therefore one of the very first of the proposals lodged with the Committee for decision.

Besides, when his delegation had submitted amendments at a similar point in 1996 and the United States and other delegations had requested that action on the corresponding draft resolution be postponed, his delegation had deferred to their wishes.

28. Mr. Tin (Myanmar), speaking on a point of order, said that the text of the draft resolution mentioned a consultative process, and the representative of Finland had spoken of negotiations with his delegation on the text.
