For the purposes of the present Statute, aggression means the use of armed force, including the initiation thereof, by an individual who is in a position of exercising control or directing the political or military action of a State, against the sovereignty, territorial integrity or political independence of a State in violation of the Charter of the United Nations.

[1. For the purpose of the present Statute [and subject to a determination by the Security Council referred to in article 10, paragraph 2, regarding the act of a State], the crime of aggression means either of the following acts committed by an individual who is in a position of exercising control or capable of directing the political or military action of a State:

A person commits the crime of aggression who, being in a position effectively[?] to exercise control over or direct the political or military action of a State, intentionally and knowingly orders or intentionally, knowingly and actively participates actively in the planning, preparation, initiation or waging of aggression committed by that State.

97. Article 8 bis of the Rome Statute, on the crime of aggression, defines aggression as a leadership crime, establishing in its paragraph 1 that it is committed by " a person in a position effectively to exercise control over or to direct the political or military action of a State " .

In fact, the reference to the capacity to effectively " exercise control over or to direct the political or military action of a State " should be understood as a factual element, linked to the person's influence and decision-making power, which applies whether the perpetrator of a crime of aggression is or is not one of persons listed in article 27, paragraph 1.
