All of the States parties had adopted measures to criminalize conduct constituting embezzlement in the private sector, a non-mandatory provision; this trend is consistent with the information presented in previous thematic reports.

Building on his previous thematic studies on the duty to consult with indigenous peoples and the responsibility of corporations to respect the rights of indigenous peoples, in 2011 the Special Rapporteur is examining issues associated with large-scale projects for the extraction or development of natural resources on or near indigenous lands.
