154. According to article 32 of the Prisons Regulation Act, the area of the prison known as the reception centre must be set aside for interviewing prisoners upon arrival. Prisoners must be categorized as follows:
154- وفيما يتعلق بالمرأة، نصت المادة 33 من قانون تنظيم السجون " يخصص مكان في السجن يسمى مركز الاستقبال تكون مهمته مقابلة السجناء عند دخولهم السجن ويتولى تصنيفهم على النحو التالي:

49. In that connection, article 41 of the Prisons Regulation Act provides that Category-B prisoners may correspond with their relatives and friends and may receive visitors, subject to the conditions established in the prison regulations.
49- وفي ذات السياق، نصت المادة رقم 41 من ذات القانون (تنظيم السجون)، على أن " للمسجون من الفئة (ب) مراسلة ذويه وأصدقائه، وأن يستقبل زائريه في حدود ما تقرره اللائحة الداخلية.

91. Under article 32 of the Department of Prisons Regulation Act, the area of the prison known as the reception centre must be set aside for interviews of prisoners upon arrival. Prisoners must be categorized as follows:

104. Article 12 of the Prisons Regulation Act states: " The prison administration shall organize prison work in conditions which approximate work conditions outside the prison, in terms of the type of work, the means by which it is performed and the tools and equipment used. "
104- تضمن قانون تنظيم السجون في المادة 12 منه ما يلي: على إدارة السجن تنظيم العمل في السجون مع تقريب ظروفه إلى ظروف العمل في خارج السجن من حيث النوع وطرق الأداء وأنواع الأدوات والآلات المستخدمة.

Without prejudice to the Code of Criminal Procedures, having due regard to article 31 of the Prisons Regulation Act No. 48 of 1991, persons in pretrial detention may see their relatives and lawyers whenever the need arises, provided that they obtain written permission from the entity that issued the detention order.
بما لا يتعارض مع أحكام قانون الإجراءات الجزائية، ومع مراعاة أحكام المادة ٣١ من قانون تنظيم السجون رقم ٤٨ لسنة ١٩٩١ يسمح للمحبوس احتياطيا بمقابلة ذويه ومحامية كلما دعت الحاجة لذلك بموجب إذن كتابي من الجهة المصدرة أمر الحبس.

Prisons Regulation Act
قانون تنظيم السجون:

The Prisons Regulation Act and its rules of procedure devote a great deal of care and attention to the matter of pregnant mothers and children born in prison; article 33, for instance, provides that a pregnant prisoner must receive special treatment and be permitted to follow a particular diet and sleep regimen.
هذا وقد تناول قانون تنظيم السجون ولائحته الداخلية الأم الحامل والأطفال المولودين داخل أسوار السجن باهتمام كبير وبعناية شديدة، حيث نصت المادة 33 على أن المسجونة الحامل تعامل معاملة خاصة وتمنح رعاية طبية خاصة من حيث الغذاء والنوم.

85. The Constitution and laws clearly provide for the prevention of torture and inhuman treatment, specifically in article 33 of the Constitution and in the Code of Criminal Procedure, the Prisons Regulation and Treatment of Prisoners Act, the Regulation on Persons Detained by the Internal Security Apparatus, the Evidence Act, and other laws already mentioned in previous reports.
85- أفرد الدستور والقوانين نصوصاً واضحة حول منع التعذيب والمعاملة غير الإنسانية وذلك في المادة 33 من الدستور وكذلك قانون الإجراءات الجنائية وقانون تنظيم السجون ومعاملة النزلاء ولائحة المعتقلين بجهاز الأمن الداخلي وقانون الإثبات وغيرها من القوانين التي سبق الإشارة إليها في التقرير السابق.

401. The Qatari legislature has established special procedures for the enforcement of pretrial detention orders issued by the Office of the Public Prosecutor in respect of women. Article 2 of the Prisons Regulation Act No. 3 of 2009 defines two types of prisons: men's prisons and women's prisons.
401- وأفرد المشرع القطري مكاناً خاصاً لتنفيذ أمر النيابة العامة بالحبس الاحتياطي للأنثى، وذلك في قانون تنظيم السجون رقم 3 لسنة 2009، حيث تضمنت المادة 2 منه تقسيم السجون إلى نوعين؛ سجن للرجال وسجن للنساء.

402. Pregnant women in prison are afforded additional rights. Article 39 of the Prisons Regulation Act states: " Pregnant prisoners shall receive the same treatment as category `A'prisoners, if they are not already in this category, and shall be exempted from prison work.
402- وحصلت المرأة الحامل على حقوق إضافية، حيث نصت المادة 39 من قانون تنظيم السجون على أن " تعامل المسجونة الحامل معاملة المسجونين من الفئة (أ) إذا لم تكن من هذه الفئة. وتعفى من العمل بالسجن.

191. Under article 4 of the Prisons Regulation Act, the Department of Prisons is expected to reeducate prisoners and instil in them a love of work and a law-abiding spirit. Prisoners may not be subjected to physical and mental abuse while serving time in prison.
١٩١- وبمقتضى المادة ٤ من قانون تنظيم السجون فإن نشاط مصلحة السجون يهدف إلى ضمان إعادة تربية المسجونين وغرس روح حب العمل والتقيد بالقوانين لديهم ولا يجوز إلحاق الضرر المادي والمعنوي بالمسجونين أثناء تنفيذهم العقوبة في السجن.

43. According to articles 17 and 18 of the Prisons Regulation Act No. 26 of 1962, no person may be imprisoned without legal authorization or a written order issued by a competent authority, and no inmate may be kept in prison beyond the period specified in the relevant imprisonment order.
43- كما من المقرر عدم سجن أي شخص بغير إذن قانوني ولا يجوز إيداع أي إنسان بالسجن إلا بأمر كتابي صادر من السلطة المختصة، كما لا يجوز استمرار حبس أي نزيل بالسجن بعد انتهاء المدة المحددة الصادرة بالأمر الصادر بإيداعه بالسجن، وذلك عملا بالمادتين 17 و18 من قانون تنظيم السجون رقم 26 لسنة 1962.

160. The legal position on this subject was explained in our previous report. Moreover, according to article 4 of the Prisons Regulation Act: " All prison staff shall assist prisoners and influence them by showing a good example in order to help them reform. "
160- فيما يخص معاملة المسجونين فقد سبق توضيح الموقف القانوني إزاء هذه الفقرة في تقريرنا السابق، كما أن قانون تنظيم السجون في المادة 4 قد أكد " على جميع العاملين في السجون مساعدة المسجونين والتأثير عليهم من خلال تقديم القدوة الحسنة والمثال الجيد لإصلاحهم.

193. The Act allows for the use of solitary confinement as a disciplinary measure and empowers prison governors to impose on any prisoner who breaks the rules and regulations issued pursuant to the Act and its implementing regulation, disciplinary measures which include up to two weeks of solitary confinement (Prisons Regulation Act, art. 34).
١٩٣- وقد جعل القانون عقوبة الحجز الانفرادي من التدابير التأديبية للسجناء حيث منح القانون مدراء السجون سلطة فرض العقوبات التأديبية على كل مسجون خالف الأنظمة والتعليمات الصادرة بموجب القانون واللائحة المنفذة له ومنها الحجز الانفرادي لمدة لا تزيد على أسبوعين (م/٣٤ من قانون تنظيم السجون).

93. Article 4 of the implementing regulation for the Prisons Regulation Act requires prison governors to ensure that no person is permitted to enter a women's prison or living quarters or workplaces at a women's prison, apart from those authorized by law to carry out their official duties there. Admission is only granted in the presence of the governor of the women's prison or her deputy.
93- ونصت المادة 4 من اللائحة التنفيذية لقانون تنظيم السجون على: " يتولى مدير السجن القيام بالواجبات التالية: أن لا يصرح لأي شخص بدخول سجن النساء أو الأماكن المخصصة لسكنهن أو عملهن فيما عدا الأشخاص المصرح لهم قانونا بذلك لأداء أعمالهم الرسمية وبحضور المشرفة على سجن النساء أو من تنوب عنها " .

156. Article 4 of the implementing regulation for the Prisons Regulation Act requires prison governors to ensure that no person is permitted to enter a women's prison or living quarters or workplaces at a women's prison, apart from those who are legally authorized to carry out their official duties there. Admission is only granted in the presence of the prison governor or her deputy.
156- ونصت المادة 4 من اللائحة التنفيذية لقانون تنظيم السجون " يتولى مدير السجن القيام بالواجبات التالية: أن لا يصرح لأي شخص بدخول سجن النساء أو الأماكن المخصصة لسكنهن أو عملهن فيما عدا الأشخاص المصرح لهم قانوناً بذلك لأداء أعمالهم الرسمية وبحضور المشرفة على سجن النساء أو من تنوب عنها " .

47. With respect to the rights of prisoners to defend themselves in disciplinary proceedings conducted in prison, article 61 of the Prisons Regulation Act (26/1962) states that prisoners must be informed of the alleged violation before any sanction can be imposed. They have the right to present their own defence or ask for certain witnesses to be heard.
47- وحول حقوق المساجين في إبداء دفاعهم خلال محاكمتهم تأديبياً داخل السجن، أتت المادة رقم 61 من قانون تنظيم السجون (26/1962)، لتنص على أن " يعلن المسجون بالمخالفة المنسوبة إليه قبل توقيع العقوبة عليه، وله الحق في إبداء أقواله دفاعاً عن نفسه كما أن له الحق في طلب سماع الشهود الذين يرى الاستشهاد بهم، وتترجم الشهادة إذا اقتضى الأمر ذلك.

28. The laws on Kuwaiti prisons draw on a policy of prisoner reform and rehabilitation whose goal is to ensure that prisoners return to society and conduct themselves as upstanding citizens after they have served their sentence. This is stated in the Prisons Regulation Act (No. 26/1962), a national law which is formulated in line with the United Nations Standard Minimum Rules for the Treatment of Prisoners.
28- يعتمد تشريع السجون في الكويت على سياسة إصلاح وتأهيل السجناء لضمان عودتهم إلى المجتمع أفراداً صالحين بعد قضاء مدة العقوبة ومحددة ذلك في قانون تنظيم السجون رقم (26/1962) كتشريع وطني يتوافق مع مبادئ وحقوق الإنسان وقواعد الأمم المتحدة النموذجية لمعاملة السجناء على حد سواء أكانوا رجالاً أو نساء ومن مظاهر ذلك ما يلي:
