The basis of this " principle " -- to use the term proposed by one author -- as applied by the Council of State is different from that used by the Constitutional Council: for the latter, the basis is the preamble to the Constitution, whereas for the former it consists of both article 31, paragraph 2, of the 1951 Geneva Convention and the law of 25 July 1952 establishing the French Office for the Protection of Refugees and Stateless Persons.

Apart from the social consequences of this procedure (in particular exclusion from the accommodation scheme and nonpayment of the waiting allowance), consideration of asylum applications is affected by the absence of the right to lodge a suspensive appeal against adverse decisions by the French Office for the Protection of Refugees and Stateless Persons (OFPRA) and OFPRA's accelerated procedure for considering asylum applications.
