41. Mr. Rosenthal suggested the following strategies that could be used for combating and prosecuting racist activities on the Internet:

In addition, a committee had been mandated to look into ways of strengthening legal protection against racism and had drawn up a report containing proposals for developing a new law prohibiting ethnic discrimination, incorporating the International Convention on the Elimination of All Forms of Racial Discrimination into domestic legislation and prohibiting organized racist activities.

Ms. Jöel Sambuc, Vice-Chairperson of the Federal Commission against Racism (Switzerland) referred to her working paper (HR/GVA/WCR/SEM.1/2000/WP.3) and stated her view that racist activity on the Internet should be subject to the same rules that were applicable to other forms of racist activities.

23. The Simon Wiesenthal Centre, which is specialized in the monitoring of online racist activities, recently released a CD-ROM entitled " Digital Hate " , which lists the sites engaged in racist propaganda.

The Committee takes note of the State party's observation that a formal ban on organizations might not be very effective in combating racism, owing to the fact that the groups involved in most of the racist activities are loose networks and not formal organizations.
475- وتحيط اللجنة علماً بملاحظة الدولة الطرف أن حظراً رسمياً على المنظمات قد لا يكون فعالاً لمكافحة العنصرية، باعتبار أن المجموعات المورطة في معظم الأنشطة العنصرية هي في واقع الأمر شبكات مفككة وليست منظمات رسمية.

(13) The Committee remains concerned: (a) at the refusal by the State party to introduce in its legislation a specific offence criminalizing and punishing acts of racist violence; and (b) at the State party's approach to prohibit racist activities of racist organizations rather than prohibiting and declaring illegal such organizations (art. 4).

His delegation welcomed the report of the Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967 on implementation of General Assembly resolution 60/251 (A/HRC/4/17), which described some of the racist activities of the occupying Power.

The Swedish position is that the provisions on agitation against a national or ethnic group, unlawful military activity, inciting rebellion, conspiracy and preparation, attempt and complicity in crimes contained in the Penal Code mean that organisations engaged in racist activities cannot pursue such activities without breaking the law.

The Act also stipulates that it is a punishable criminal offence for anyone to issue pamphlets or material inciting racial hatred or encouraging the funding of racist activities, which are contrary to the law.
كما أنه يجرِّم من يقوم بإصدار نشرات أو مواد تحرض على الكراهية أو تمويل أنشطة عنصرية حيث تعتبر هذه الأفعال غير مشروعة ويعاقب عليها النظام.

In this connection, harsh penalties must be introduced for governmental agents who are involved or acquiesce in racist activities or who condone or do not intervene to prevent such activities.
ويجب اﻷخذ في هذا الصدد بعقوبات صارمة تُطبﱠق على الموظفين الحكوميين الذين يشتركون في أنشطة عنصرية أو يقبلون بها أو الذين يتغاضون عن هذه اﻷنشطة أو لا يتدخلون لمنعها.

58. Sweden reiterated that organizations involved in racist activities were breaking the law and were being countered through legislation and the police.
58- وكررت السويد التأكيد على أن المنظمات الضالعة في أنشطة عنصرية مخالفة للقانون ويجري التصدي لها عن طريق التشريعات والشرطة.

265. In view of the importance of measures in the fields of teaching, education and culture to combat prejudices that lead to racial discrimination, the Committee requests the State party to provide information to it on which measures it has found most effective, and which measures can reach those sections of the population most likely to engage in racist activities.
٢٦٥ - ونظرا ﻷهمية التدابير التي تتخذ في ميادين التدريس والتعليم والثقافة الرامية الى مكافحة التغرض الذي يؤدي الى التمييز العنصري، تطلب اللجنة الى الدولة الطرف أن تقدم إليها معلومات عن التدابير التي وجدت أنها أنجع التدابير وعن التدابير التي يمكن أن يمتد مفعولها الى قطاعات السكان اﻷكثر احتمالا أن تمارس أنشطة عنصرية.
