71. In regard to adoption and foster placement (kafalah), the laws regulate the latter in accordance with the Islamic Shariah, while adoption is regulated by the laws of non-Muslim confessions.

The Committee notes that with regard to adoption, article 21, paragraph (a) of the Convention stipulates that " the persons concerned have given their informed consent " which should be considered in the context of the right of the child to express his or her views and have them considered in accordance with the age and maturity of the child.
