It contains information on activities undertaken at the international level to enhance the dissemination of principles relating to the status of national institutions and thus trigger the promotion of such institutions in countries that do not have any.

I. PRESENTATION OF THE PRINCIPLES relating to the status of national institutions

They reaffirmed that the status and responsibilities of national institutions should be consistent with the principles relating to the status of national institutions adopted by the General Assembly in resolution 48/134 of 20 December 1993.
وأكدوا من جديد أن مركز المؤسسات الوطنية ومسؤولياتها ينبغي أن تكون متسقة والمبادئ المتصلة بمركز المؤسسات الوطنية التي اعتمدتها الجمعية العامة في قرارها 48/134 المؤرخ 20 كانون الأول/ديسمبر 1993.

UNSOM encouraged the Government to undertake broad consultations on the bill and to take account of the Paris principles relating to the status of national institutions.
وشجعت البعثة الحكومةَ على إجراء مشاورات واسعة النطاق بشأن مشروع القانون لمراعاة مبادئ باريس المتعلقة بمركز المؤسسات الوطنية.

The need to establish a set of principles or guidelines for the establishment and effectiveness of such commissions led to the preparation of the Principles relating to the status of national institutions, known also as the Paris Principles.

12. In their recommendations, the participants in the Commonwealth Workshop stressed that in the establishment and operation of national institutions, due attention should be paid to the " Principles relating to the status of national institutions " , particularly in relation to:

Recalling further the Principles relating to the status of national institutions for the promotion and protection of human rights, welcomed by the General Assembly in its resolution 48/134 of 20 December 1993 and annexed thereto,
وإذ تذكر كذلك بالمبادئ المتعلقة بمركز المؤسسات الوطنية المعنية بتعزيز حقوق الإنسان وحمايتها، التي رحبت بها الجمعية العامة في قرارها 48/134 المؤرخ 20 كانون الأول/ديسمبر 1993 والمرفقة بذلك القرار،

Recalling that in its resolution 48/134 of 20 December 1993 the Assembly welcomed the principles relating to the status of national institutions for the promotion and protection of human rights, annexed to that resolution,
وإذ تشير إلى أن الجمعية العامة في قرارها ٤٨/١٣٤ المؤرخ ٢٠ كانون اﻷول/ ديسمبر ١٩٩٣ قد رحبت بالمبادئ المتعلقة بمركز المؤسسات الوطنية لتعزيز وحماية حقوق اﻹنسان، بصيغتها الواردة في مرفق ذلك القرار،

1. Reaffirms the importance of the development of effective, independent, pluralistic national institutions for the promotion and protection of human rights in conformity with the Principles relating to the status of national institutions annexed to General Assembly resolution 48/134;
١- تعيد تأكيد أهمية إنشاء مؤسسات وطنية فعالة ومستقلة وتعددية لتعزيز وحماية حقوق اﻹنسان على نحو يتمشى مع المبادئ المتعلقة بمركز المؤسسات الوطنية والمرفقة بقرار الجمعية العامة ٨٤/٤٣١؛

Recalling that, in its resolution 48/134 of 20 December 1993, the Assembly welcomed the principles relating to the status of national institutions for the promotion and protection of human rights, annexed to that resolution,
وإذ تشير إلى أن قرارها ٤٨/١٣٤ المؤرخ ٢٠ كانون اﻷول/ ديسمبر ١٩٩٣ رحب بالمبادئ المتعلقة بمركز المؤسسات الوطنية لتعزيز وحماية حقوق اﻹنسان، بصيغتها الواردة في مرفق ذلك القرار،

Recalling that, in General Assembly resolution 48/134, the Assembly welcomed the Principles relating to the status of national institutions for the promotion and protection of human rights, annexed to that resolution,

4. Emphasizes in this regard the need to disseminate the Principles relating to the status of national institutions for the promotion and protection of human rights, annexed to General Assembly resolution 48/134, as widely as possible, and calls upon the Secretary-General to undertake this task;
٤- تشدد في هذا الخصوص على ضرورة نشر المبادئ المتعلقة بمركز المؤسسات الوطنية لتعزيز وحماية حقوق اﻹنسان على أوسع نطاق ممكن، وتدعو اﻷمين العام إلى الاضطلاع بهذه المهمة؛

17. Encourages Governments and national institutions to take account, in their policy and practice in this area, of the provisions contained in the Principles relating to the status of national institutions for the promotion and protection of human rights;
٧١- تشجع الحكومات والمؤسسات الوطنية على أن تأخذ في الاعتبار، في سياساتها وممارساتها في هذا المجال، اﻷحكام الواردة في المبادئ المتعلقة بمركز المؤسسات الوطنية لتعزيز وحماية حقوق اﻹنسان؛

The General Assembly welcomed the Principles relating to the status of national institutions (resolution 48/134, annex).
ورحبت الجمعية العامة بالمبادئ المتعلقة بمركز المؤسسات الوطنية )القرار ٨٤/٤٣١، المرفق(.

Recalling the principles relating to the status of national institutions for the promotion and protection of human rights ( " the Paris Principles " ),
وإذ تشير إلى المبادئ المتعلقة بمركز المؤسسات الوطنية لتعزيز حقوق الإنسان وحمايتها ( " مبادئ باريس " )(

In this respect, attention should be paid to article 18, paragraph 4, of the Optional Protocol which calls upon States parties to give due consideration to the Paris Principles relating to the status of national institutions for the Promotion and Protection of Human Rights and to the importance of a public, inclusive and transparent process in the appointment of its members.
وينبغي إيلاء اهتمام في هذا الصدد للفقرة 4 من المادة 18 من البروتوكول الاختياري التي تدعو الدول الأعضاء إلى النظر كما ينبغي في مبادئ باريس المتعلقة بمركز المؤسسات الوطنية لتعزيز وحماية حقوق الإنسان وفي أهمية اتباع عملية علنية وشاملة وشفافة بشأن تعيين أعضاء اللجنة.

4. When establishing national preventive mechanisms, States Parties shall give due consideration to the Principles relating to the status of national institutions for the promotion and protection of human rights.
4 - تولي الدول الأطراف، عند إنشاء الآليات الوقائية الوطنية، الاعتبار الواجب للمبادئ المتصلة بمركز المؤسسات الوطنية لتعزيز وحماية حقوق الإنسان.

Lastly, she urged the Government to establish an independent national human rights institution in accordance with the Principles relating to the status of national institutions for the Promotion and Protection of Human Rights.
وختاما حثت الحكومة على إنشاء مؤسسة وطنية مستقلة لحقوق الإنسان وفقا للمبادئ المتعلقة بحالة المؤسسات الوطنية لتعزيز وحماية حقوق الإنسان.

The Special Rapporteur recommends that the Government give serious consideration to the establishment of a separate and autonomous national human rights institution that would act independently of any other State authority or ministry functioning as part of the Government, in accordance with the Paris Principles relating to the status of national institutions.
141- ويوصي المقرر الخاص بأن تولي الحكومة اهتماماً خاصاً للنظر في مسألة إنشاء مؤسسة وطنية منفصلة ومستقلة لحقوق الإنسان تعمل وفقاً لمبادئ باريس الخاصة بمركز المؤسسات الوطنية وبصفة مستقلة عن أي سلطة أو وزارة أخرى تابعة لجهاز الدولة.

7. The Committee urges the State party to take the necessary measures to ensure the independence of the National Human Rights Commission in conformity with the principles relating to the status of national institutions for the promotion and protection of human rights (the Paris Principles).
7- تحث اللجنة الدولة الطرف على اتخاذ التدابير اللازمة لكفالة استقلال اللجنة الوطنية لحقوق الإنسان وفقاً للمبادئ التي تتعلق بمركز المؤسسات الوطنية لتعزيز حقوق الإنسان وحمايتها (مبادئ باريس).

89. The present functioning of the National Commission does not respect the Paris Principles relating to the status of national institutions of human rights.
89- ولا يفي الأداء الحالي لهذه اللجنة بمبادئ باريس المتعلقة بالمؤسسات الوطنية لحقوق الإنسان.

It stated that there was no national human rights institution in full compliance with the principles relating to the status of national institutions for the promotion and protection of human rights (Paris Principles).
وقالت تونس إنه لا توجد في الجمهورية التشيكية مؤسسة وطنية معنية بحقوق الإنسان تمتثل بشكل تام للمبادئ المتصلة بوضع المؤسسات الوطنية لتعزيز وحماية حقوق الإنسان (مبادئ باريس).

States must ensure the independent status and competences of such bodies in line with the principles relating to the status of national institutions for the promotion and protection of human rights (Paris Principles), as well as ensuring adequate funding and transparent procedures for the appointment and removal of their members;
ويجب على الدول أن تضمن استقلالية هذه الهيئات من حيث المركز والصلاحيات وفقاً للمبادئ المتصلة بحالة المؤسسات الوطنية وتعزيز وحماية حقوق الإنسان " مبادئ باريس " ، فضلاً عن ضمان تمويل كافٍ وإجراءات شفافة لتعيين أعضائها وعزلهم؛

59. The Commission should encourage States and national institutions to observe the provisions contained in the Principles relating to the status of national institutions and invite them to take action to have these Principles introduced into their domestic legislation.
٩٥- ويجب على اللجنة أن تشجع الدول والمؤسسات الوطنية على الامتثال للنصوص الواردة في المبادئ فيما يتعلق بمركز المؤسسات الوطنية وأن تدعوها إلى العمل في اتجاه تطبيق هذه المبادئ في تشريعاتها الوطنية.

As regarded implementation of the Optional Protocol, the President of Brazil had recently sent to the Congress a draft law for the establishment of a national preventive mechanism, the structure of which would be in accordance with the Principles relating to the status of national institutions.
وفيما يتعلق بتنفيذ البروتوكول الاختياري، فقد بعث رئيس البرازيل مؤخرا بمشروع قانون إلى الكونغرس من أجل إنشاء آلية وطنية للوقاية، سيكون هيكلها وفقا للمبادئ ذات الصلة بمركز المؤسسات الوطنية.

The Principles relating to the status of national institutions for the promotion and protection of human rights (the Paris Principles) (General Assembly resolution 48/134) should be taken into consideration in the elaboration of the constitutional reform relating to the Human Rights Commission.
وينبغي مراعاة المبادئ المتعلقة بوضع المؤسسات الوطنية لتعزيز وحماية حقوق الإنسان (مبادئ باريس) (قرار الجمعية العامة 48/134) عند إعداد الإصلاح الدستوري الخاص بلجنة حقوق الإنسان.
