The presidential decree pardoning the author was adopted in the exercise of the President's constitutional prerogative to pardon. Pardon operates outside the framework of administration of justice in criminal cases, which requires compliance with articles 10 and 54 of the Russian Criminal Code, proscribing the retroactive application of the law aggravating the liability of a person.

After an inquiry by the city procurator's office, criminal proceedings were instituted under article 171, section 2, of the Russian Criminal Code (exceeding of power or official authority).

In the absence of traditional grounds for jurisdiction such as territoriality or the nationality of the victim, the Russian Criminal Code permitted universal jurisdiction to be exercised solely in cases covered by international treaty, thus permitting Russian courts to institute proceedings for genocide, war crimes and piracy, among others.
وفي غياب الأسس التقليدية للولاية القضائية مثل الإقليمية أو جنسية الضحية، فإن القانون الجنائي الروسي لا يسمح بممارسة الولاية القضائية العالمية إلا في الحالات التي تشملها معاهدة دولية ما، مما يتيح للمحاكم الروسية إمكانية رفع دعوى على المتهمين بالإبادة الجماعية وجرائم الحرب والقرصنة، من بين جرائم أخرى.
