Under the Covenant, States are prohibited from deliberately taking any retrogressive measures, including in regard to the right to social security, unless they can prove that they have only been introduced after the most careful consideration of all other alternatives and are duly justified by reference to the totality of the rights stipulated in the Covenant.

There is a strong presumption that retrogressive measures are prohibited under the Covenant, unless concerned States are able to prove that the measures have been introduced after most careful consideration of all alternatives, and that they are justified by reference to the totality of the rights stipulated in the Covenant.
