Principle 4 states that " any form of detention or imprisonment and all measures affecting the human rights of a person under any form of detention or imprisonment shall be ordered by, or be subject to the effective control of, a judicial or other authority " .

The Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment (General Assembly 43/173 of 9 December 1988) reiterates that any form of detention or imprisonment shall be ordered by, or be subject to the effective control of a judicial or other authority.
وتؤكد مجمـوعة المبادئ المتعلـقة بحماية جميع الأشخاص الذين يتعرضون لأي شكل من أشكال الاحتجاز أو السجن (قرار الجمعية العامة 43/173 المؤرخ 9 كانون الأول/ديسمبر 1988) على عدم حدوث أي شكل من أشكال الاحتجاز أو السجن إلا إذا كان بأمر من سلطة قضائية أو سلطة أخرى أو كان خاضعاً لرقابتها الفعلية.
